Army doctor half done with prison term for questioning Obama eligibility
A military doctor who was court-martialed and sent to prison after questioning Barack Obama's eligibility to be president and refusing to follow orders that descended from the commander-in-chief is more than halfway through his sentence.
And now he has asked the nation in his writings to ponder the question of whether it is bound by the Constitution.
Dr. Terry Lakin, an Army doctor who refused to deploy again to Afghanistan when his chain of command refused to verify that Obama legitimately is president, is serving a six-month term at Ft. Leavenworth in Kansas.
He remains under the Uniform Code of Military Justice but has been allowed to post online a series of observations he's made while serving his time. Those private communications to the Terry Lakin Action Fund suggest that his focus remains on the foundations of the nation and the rights and responsibilities of its citizens.

So....should someone actually get proof that obama is ineligible, will LTC Lakin’s conviction be expunged and he get back pay and such? If obama is found ineligible he should be imprisoned along with the congresscritters who “validated” his eligibility.

ANY soldier of any rank has to follow orders and do his/her job, as long as it’s a LEGAL order. Colonel Lakin received his orders, decided they were not legal, and he had a Constitutional responsibility to NOT follow those orders. Any honorable Officer or enlisted man, who honestly believed Obama wasn’t elected in accordance with the Constitution, would have NO CHOICE but to refuse his/her orders.
Why more soldiers didn’t do the same thing as the Colonel, I don’t know. I assume most young enlisted types don’t take the Constitution as seriously as they should. Some probably went along with things because they didn’t want to ruin their careers.
All I know is that I have the highest respect for Colonel Lakin. He did what he felt was right, and what he felt his duty was, and he paid the price for it, willingly. He has brought honor upon himself, the Army, and this Nation.

You are profoundly ignorant on this point. Officers of the Armed Forces are bound to follow LAWFUL orders and likewise bound to disobey unlawful orders.
So, the question is: was the order that LTC Lakin received to deploy lawful and was he bound to follow it? As he freely acknowledged in the court martial proceedings, the order was lawful and his guilty plea was accepted only after a thorough questioning by the judge to ascertain the defendants understanding of the legal issue.
Lakin was a foil of the birther crowd and he was stupid to be talked into doing their bidding. He now sits in his cell a few miles from my farm. I hope that when he walks out of the gates of the USDB he is a little wiser.
It was to have been his fourth tour. He is a hero in my book.

If I recall correctly, the charges he faced and was convicted of was were equal to a felony conviction, since the potential penalty was greater than one year. The actual penalty doesn't matter, from what I have read. It's the sentencing range.
If that is correct, it probably depends on the state he's licensed to practice in. Each state has its own rules regarding the conditions under which one is licensed to practice.

Dismissal from service = Dishonorable Discharge for an officer = felony conviction. At a minimum he loses RKBA. Unsure how this affects his professional licensing.

Look ‘em up, you might learn something about what it means to be a hero.

What do you say to wounded warriors about a CinC that kept their surgeon off the battlefield, simply because the Cinc refused to show a common, ordinary document he stated was in his possession?
Those wounded warriors understand the surgeon was acting in the highest principle, what can you say about their CinC?

Thank you for your insightful remarks, but you clearly don’t know what you are talking about. Barry McCaffrey received not one, but two Distinguished Service Crosses. This is not about politics, but I certainly do not consider any politician to be a hero, they are self serving little egomaniaces and what Lakin did was a political stunt of the first order.
