Permit me to rephrase it. Shouldn’t the same thing be said of defending the law?
The government passes the law and then must defend it. It is the citizens that challenge laws they deem unconstitutional.

The issue is ENFORCEMENT.
Short of Impeachment or the Withholding of of funds, there is no mechanism of enforcement. A POTUS can still act as he chooses.
You captured exactly how it appears to be going. Sadly, there are plenty who, as American citizens, sit gloating while all of this happens.
There is one more way - the ballot box. The blacks [who are in the majority] in DC are already pissed off that the DC Council passed gay marriage over their objections [the blacks are mostly Southern Baptist]. They are also REALLY pissed off that the question was PREVENTED from going to referendum in the last election.
Now, with Obama NOT defending DOMA - I think they are gonna be REALLY REALLY pissed off ...

Britain - everything is illegal, cameras on every street corner, crazier about children than US (photo of your kid in the bath = sex offender's list, completely enshrined class system
Australia - internet censorship, video games for adults are regularly banned, everything there can kill you
Scandinavia - ridiculous government restrictions on everything, have to pick from a list of approved baby names, high taxes
Germany - video games are "children's toys" and as such games for adults are banned outright, heavy limits on speech including talking about the Third Reich in any way
Japan - general expectation and encouragement of government regulation, very strict social etiquette that allows the rich to treat the lower classes like shit, creepy gang culture

Each branch must determine the constitutionality of its own particular actions, on its own.
There is absolutely nothing in Art III that sets up an American Cour de Cassation like they have in France. The USSC "power" of judicial review, correctly applied, extends only to cases before the court where a violation of a law is at hand. THEN, the Court must decide (for itself) whether a decision would enforce a law which is not a law because it violates the Constitution.
The Congress and the President have analogous powers in their own spheres.
The President cannot fail to enforce an Act of Congress signed by a President, but he can in fact, he must, decide the scope of work of the Justice Department - that's his right, and his responsibility.
Well, the theory behind that working properly banks on the occupant of the WH having at least a passing interest in upholding the Constitution. With a wannabe despot (who considers the Constitution an impediment) in the position, we have serious problems.
