Late last week, the Arizona Senate passed Senate Bill 1178, the Intrastate Commerce Act. The bill provides that all services performed in the state, and all goods grown or made here for consumption within Arizona are not subject to the authority of Congress under its constitutional power to regulate commerce among the several states.
The vote was 21-8-1
Included in the bills language are penalties for federal agents violating the state law in James Madisons words, interposition, or standing between the federal government and the people of the state.
The bill states that any federal agent or employee who attempts to enforce any federal act, rule or regulation over these activities is guilty of a Class 6 felony. While the measure does not seek jail time, it allows fines of up to $2,000. And any state official that tries to enforce a federal law could face a $500 fine.
Sen. Sylvia Allen, R-Snowflake, who crafted most of the proposals, said its time Arizona stood up to the federal government. And she said if arresting some federal officials is what it takes, shes prepared to do that.
If we dont show that were serious about this, then how is the federal government going to respect us? Allen continued. Instead, they come into our state and they fine us
and fine our businesses and our farmers.

My husband and I have lived most of our childhoods and all of our adult lives in Arizona. We are proud that our state is being sued right and left by the Obama administration. Means we’re doing something RIGHT. Stand your ground, Jan!
From the first paragraph, it appears that "these activities" are:
"[...] all services performed in the state, and all goods grown or made here for consumption within Arizona [, which] 'are not subject to the authority of Congress under its constitutional power to regulate commerce among the several states.'"
OK, just don't ask me to hold it while you do something outstanding.
≤};^)
Usually the folks in the Darwin Awards are credited for saying things like that.
“Hey dude, hold my beer. I have an idea.”
Yes, we know. But we can hope.
The next election, I hope, will bring someone of Jan Brewers ilk and testicular fortitude?
If any state can find another Jan Brewer....it would be Texas.
Rick Perry is just a fraud, a Bush Liberal RINO
Congress is allowed to pass all laws “necessary and proper” to carry out its duties, as set forth in Article 1, Section 8.
But that only applies to laws that Congress passes to enact their PROPER duties. Just because Congress passes a law DOES NOT make that law “necessary and proper” and therefore the supreme law of the land. (And the Supreme Court does NOT have ultimate juridiction here ... WE DO!)
Arizona has every right to nullify a law that it deems to be in violation of the Constitution. Each of the several States holds that right, since they are party to the contract that created THEIR created central government.
The feds had better wake up to the fact that they are a limited entity, and do so BEFORE the states figure out that their creation needs a good beat-down!
Preaching to the choir.
I am still puzzled that we can’t find anyone that is NOT a RINO to bid against him in the primary.
I am not feeling good about being a Texan right now.
But hey, we still have the cannon and we’re still waiting for someone to come and take it.
(Look it up)
hate to say this, but some of the Several States would be quite broke not being able to house Federal prisoners for Uncle Sam. The County Sheriff gets alot of equipment and income from DC in this way. This bill would sure kill that.
Awesome!...except how did this state re-elect John McCain again?
The missing “nanny state”ism. People aren’t used to that.
Nice job! If it fails try, try, try again! Never give up!
We will admission them into the ground! Make the land as hostile to their unconstitutional intrusions as possible.
Make governing domestically as difficult and unworthy of their effort as possible. Let the warring shot be fired. and let the republican patriots in congress take note and uses that shot to justify further cuts.
Tell their big government democratic counterparts that the States want not their interference, and they should therefore wast not our money paying for it.
Force them to focus on the actual foreign responsibility of the Federal government. You know foreign responsibility ranging from illegal immigration, to foreign wars both economic(trade manipulation) and military.
Does that mean Rick Perry squats to pee??
“Does that mean Rick Perry squats to pee??”
Caut with his pants down.. If the Texas Legislator fails to get at least this far they could be declared coward.
Out Texan by a bunch of Arizonans... Pitiful...
Mixed feelings ~ping~
“Sen. Sylvia Allen”
Again, conservative women showing the way!
Indeed. The emasculation of America is very near completion.
Thanks ForGod’sSake.
“hate to say this, but some of the Several States would be quite broke not being able to house Federal prisoners for Uncle Sam. The County Sheriff gets alot of equipment and income from DC in this way. This bill would sure kill that.”
If the money stayed at home it wouldn’t have to come from the fed.
It’s about time! The Commerce Clause has been misused to a ridiculous degree to nationalize almost all governmental decision making.
THANK YOU! Finally someone gets it. The reason they call them a different name is because sales taxes would be illegal, then they somehow think the name itself makes a difference and that we won't notice that it's the same percentage levied on the same goods as the sales tax would be on intrastate purchases.
