Taking Back the Commerce Clause in Virginia [Virginia House Rejects Federal Commerce Power, 65-33]
Tenth Amendment Center ^ | 01-26-11 | Michael Boldin

Posted on 01/26/2011 11:55:38 AM PST by RepublicnotaDemocracy

Today, the Virginia House of Delegates overwhelmingly passed House Bill 1438 (HB1438), the Intrastate Commerce Act. The bill, “Provides that all goods produced or manufactured within the Commonwealth, when such goods are held, retained, or maintained in the Commonwealth, shall not be subject to federal law, federal regulation, or the constitutional power of the United States Congress to regulate interstate commerce.”

The vote was 65-33.

For decades, using a tortured definition of “interstate commerce,” Congress has claimed the authority to regulate, control, ban, or mandate virtually everything – from wheat grown on one’s own land for personal consumption, to weed grown in an individual’s own home for the same purpose, to guns manufactured, sold and kept in state boundaries, and everything in between. And, unfortunately, the Supreme Court has largely condoned and even encouraged such reprehensible legislative behavior.

But today, Virginia is once again leading the way in saying “Back Off” to the feds – by standing up for the Constitution as the founders gave it to us.

Can 0bama order an invasion of this insurrectionist state?

Look at the John Warner Defense Act, Section 1076:

"(1) The President may employ the armed forces, including the National Guard in Federal service, to—

. . . .

"(B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).

. . . .

"(B) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.

For those of you who think the "R" by a congressman's name is going to save us all, remember that this "law" was sponsored by a Republican during the term of a Republican president.

We need to stop having so much faith in the "party" candidates and elect those who truly support, and believe in, conservative principles. I'm tired of being punked by smooth-talking liars.

Would this allow a Virginia only health insurance company and hospitals in Virgina to get out of Obamacare?

Let me know when it's time to man the barricades.

Hampton Roads and the south flank are covered, as are the western frontiers. The northern regions need bolstering, however.

That'd make some headlines, wouldn't it.

If this bill is enacted, wouldn't that de-claw the US Supreme Court since they, being the federal government, would no longer have jurisdiction?

It is about time! The commerce clause was NEVER intended to give congress the power to regulate any trade between the People, just the several States. The reason the word states is capitalized is significant and cannot be overlooked as the supreme court black robed terrorists have seen fit to do. If it meant how they interpret it, how come the words the People are not found anywhere in the commerce clause? It means if one state imposed trade barriers on another state, the feds could step in and be the trade ref, period!

Can you carry it openly, in government buildings (right into the governor's office), and from locality to locality without having to worry about different gun regs as you cross their boundaries?

I can do that too.

"VIRGINIA"

There was a time...

A time of splendor and grace

When the world moved by

At a kinder pace

There was a land...

A land to pleasure the eyes

Where the old was new

And the foolish wise

I can hear Virginia

When the south wind sings

And I see her shining

On a blackbird's silver wings

And I can feel Virginia

Runnin; through my soul

When the flag unfurls

And drummers start their long, long roll

Oh, sacred ground

For which so many have died

Let us take our turn

For our country's pride

Oh, blessed place

Remember all of your sons

Who will stand and fall

'Neath the ceaseless guns

I can hear Virginia

When the south wind sings

And I see her shining

On a blackbird's silver wings

And I can feel Virginia

Runnin' through my soul

When the flag unfurls

And drummers start their long, long roll

Will I ever see her rise again?

Or are the old days gone, has the world moved on?

Will she ever grace our eyes again?

Tell me when?

I can hear Virginia

When the south wind sings

And I see her shining

On a blackbird's silver wings

And I can feel Virginia

Runnin' through my soul

When the flag unfurls

And drummers start their long, long roll.
