The Illinois Supreme Court has granted Rahm Emanuel's stay. Which means he's back on the ballot.
Earlier today Emanuel's spokesman Ben Labolt said he had plans to turn to the U.S. Supreme Court if Emanuel doesn't receive a favorable ruling from the state.
Emanuel's lawyers filed an emergency appeal with the Illinois Supreme Court, asking to have him re-added to ballots. Today, ballots are being printed without Emanuel's name after an Illinois Appellate Court residency decision on Monday booted him.
Some believe Emanuel will look at a First Amendment question for the U.S. court to weigh in if a state ruling doesn't go his way
There is no longer any rule of law, apparently.
It’s very unlikely that SCOTUS would accept the case. They have refused to do so in several similar cases, including the NJ senate race where the Democrats cheated in 2000 and the recent race in Alaska where Murkowski supporters cheated.
I think it all boils down to this: What does the Chicago Mafia want? It seems unlikely that the appellate court would have found against Rahm unless Daley and the Machine approved. And although Obama says he supports Rahm, some have their doubts.
Well, it’s up to the Illinois Supreme Court, IMHO.

I dunno, the state elections guy said today they had to go to print based on the Appeals Court decision, so the Supremes stepped in to prevent that. But the elections guy said they’d have to destroy and reprint the ballots if the decision was reversed, so I’d say that will still be the case.

Chicago is totally corrupt.
If he can’t weasel his way back on the ballot, he isn’t corrupt enough to be the Mayor of Chicago.

Since there’s no basis for a stay, it’s most likely reflecting the final decision.
This is why real cases get slowed down, when that which is clear to see from the lowest court gets muddied up by ignoring straightforward laws.
