In the not too distant past there was always the idea you could fall back to the wilderness if you had too in times of extreme upheaval.

Now, if you even dared try it, you’d be shot on sight to protect any wild animals, or vegetation there from being bruised.

Actually, Alaska is sounding a lot better with each passing day. Somewhere about 500 miles from the nearest neighbor should be just about right.

If he was told of the easement when he bought the property, then he must comply with it. If the title search did not reveal the easement, then he can sue the title company.

Sounds like a clear case of trespassing to me.

I hope he sues them for everything he can. Easement violations are one thing, trespassing is criminal. Someone should be going to jail.

Many years ago my grandfather had a government worker, a game warden pull down on him while he and some others were hunting deer out of season. They turn the tables on him, tied him to a tree with barbed wire and left him there in the woods for three days before calling his offices to tell them where they could find him. He left the service and moved out of the area. It has nothing to do with anything but I thought it made a good story.

If he purchased the land with the easement in place, then he is in the wrong. He might have an action against the seller and / or his attorney if the easement was not disclosed but that’s not likely.

They guy apparently bought the property knowing there was an easment on it already. The previous owners sold out -- unless they were coerced. Nonetheless, the new owner bought the land knowing he would have to abide by the easment.
