Can the new congress offer a new bill to make it illegal to be a homosexual in the military?

It is already against the rules, that was the whole point of don't ask, don't tell. Clinton didn't have the guts to make it legit to serve openly gay, so he created this policy which means the rules won't be enforced as long as you lay low. In other words, we won't ask and if you don't tell us as far as we're concerned we know nothing. But if for some reason we do find out, well, you're out. This is what we've had since the 90s.

They could already serve, so long as they didn’t go out of their way to engage in sodomy and otherwise act on their homosexuality. This now lets them do that openly. Disgusting.

We’re all sittin’ here, moaning and groaning about this, instead of getting off our duffs to do something.
We outnumber the homos by a large, large majority. The Senate is scared of them because they are organized. Why don’t we organize, for God’s sake?!
You know why we’re always looking over our shoulder? Because we always let them put us on the defensive. If i think someone behind me is thinking about stabbing me in the back, I turn around, call them out and engage them until I win or they kill me. Standing there hoping they decide just to wound me or not stab me sure as hell doesn’t do any good.
Technically, yes. Realistically, no. Anyway, liberal courts would strike the law down as "unconstitutional" after the sodomites get their foot in the door.
