Army birther pleads guilty to 1 of 2 charges

An Army doctor who disobeyed orders to deploy to Afghanistan because he questions Barack Obama's eligibility to be president has pleaded guilty to 1 of 2 charges against him.

At a court-martial proceeding Tuesday in Maryland, Lt. Col. Terrence Lakin of Greeley, Colo., pleaded guilty to not meeting with a superior when ordered to do so and not showing up at Fort Campbell in Kentucky where he was supposed to report.

If the plane Lakin was ordered to get on as the first leg of his combat deployment would have been destined for Iran would the orders have been lawful?

They weren't orders to go to Iran. Nor Oz. Nor to Narnia.

I think it was Kentucky.

It may do you some good to get on with going to work or maybe going for a long tiring walk, bicycle ride or some form of tension release.

Right now you aren’t doing yourself or your cause any good. You have become emotionally invested in this case when it never was about what you think it was. I say that in that the charges brought against LTC Lakin weren’t outside the pervue of the officers that issued them. Thus the President and his standing had nothing to do with LTC Lakin being issued the orders. The military isn’t the place to do what you want done. It resides in the Congress via the impeachment process. Barring the Congress taking action the next venue comes in Nov. 2012 via the ballot box.

Nonsense. There is no basis for your claim that Puckett made “Lakin’s landing as soft as possible.”

HELLO! LAKIN HAS NOT BEEN SENTENCED YET!

For all you know, olddeck, Lakin will get the maximum sentence on both counts.

Competent lawyers do not plead their clients guilty without an agreement on the terms of the sentence.

GET A CLUE, olddeck.

Step One: Find a sympathetic prosecuting attorney who is not a fan of Barry Soetoro. That prosecutor can be a district attorney, a state Attorney General, a US Attorney or a Special Counsel of your choosing.
Step Two: Present that evidence to said prosecutor.
Step Three: Ask that said prosecutor launch a Grand Jury investigation into election fraud, perjury, false documents, forgery or any charge that your little heart desires.

I remember during Basic Training, Ft. Ord, spring 1969. I was ordered to deploy to KP duty at the Mess Hall.

Hypothetical example:

Said myself to me: I think I will challenge the validity of the Drill Sargeant’s order, for me to serve KP for 18 long hours.

I thought: How about if I refuse to pull KP, until shown the entire chain of command, from President, all the way down to my Drill Sargeant?

My Drill Sargeant was also a Native American. At points in US history they have been deemed to be not citizens of the US, or at least as I remember from history classes.

I would contend the non-citizen Drill Sargeant can’t issue a lawful order to me.

Plus, that is what my trainee buddy said, and he had taken business law, and hoped this scheme would work for me, so he might try it.

Anyway it didn’t work out well for me. My Drill Sargeant didn’t take to kindly to my demand to see proof that his order was lawful.

Neither did the Company CO, on up to the base commander.

I see little or no difference between every order issued by an E5 to an E3, and this case.

And I don’t think the military or civilian courts do, or will, either.

Lakin is a volunteer for all this trouble, not a victim, just I would have been for refusing KP duty..

My example is straight forward, and does not require counting pixels, or listening to a real estate broker-dentist-lawyer insult court officers with name calling.

During WWII there were citizen-soldiers in the US military who felt FDR was a scoundrel. Maybe that he had purposely allowed Pearl Harbor, for instance. Said soldier could have contended FDR had failed the Constitution. Certainly whenever conscription takes place, a few might asert as strong a case as they can dream up, to not deploy.

During Vietnam, many conscripts and even volunteers tried a variety of ploys, to oppose the war, and take themselves out of it.

I considered it, but served instead. And wound up in AG (G1, Adjutant General), where I saw the cases of claimed “COs” both enlisted and officer.

IOW I witnessed a lot of “draft dodgers” who did so from their “conscience,” which might impress some people.

I don’t know about you but I was always warned prior to a deployment that Missing Movement in wartime was a capital offense.

Maybe it was different in your New Navy...

I believe Obama is a communist traitor who should not have been elected. But, unfortunately, he was. And he was sworn in and is now the lawful president and commander-in-chief. Those are the indisputable facts in the matter. Whether he’s eligible or not not is no longer the issue. How to impeach or defeat him is now the question. Sorry, but individual military officers do not have the option of not following his orders.

By the way, if you are correct and Lakin is correct and Obanma’s orders are unlawful, should all of our military officers simply refuse to obey his orders? Or would that be RIDICULOUS?

Lakin refused to swallow the big lie that his commanding officers have swallowed. Even Michelle Obama doesn't buy it, as she has stated his home country is Kenya.

I have relatives that have a picture of a Nazi Soldier dressed in full Nazi uniform hanging in their living room. He was a loving brother who died in the war marching into Russia, and he was missed by his Brother after the war. So yes, not all Nazis were bad, and all of them were just following orders from their superiors. They never refused an order.

So why the negative connotation of “Executioner” toward all Nazi Soldiers who simply followed legal orders? A little sensitive for some reason?

I would say that if Obama is ineligible then everything he has done as president is unconstitutional, most of it is anyway even if he is eligible.

It is the swore duty of our officer corps to protect the Constitution first and foremost and by any means necessary, for instance The Marine Commandant General Smedley D.Butler averted a Fascist coup d’etat in 1932 by basically saying whatever army you raise he would raise one bigger and defeat it after the Fascists offered him the command of their army.

The Coup d’etat’s leaders flinched and hid their aborted attempt while their cohorts in Congress branded a Man who was received the Medal of Honor twice as some sort of a lunatic for protecting The Constitution.

Is it ridiculous to believe that our officers would and should protect our constitution no matter what might happen to them because they are honor bound to do so?

With all due respect Jim...this is much bigger than Barry. Much bigger than party politics. Much bigger, longer term.

If we ignore his born with foreign citizenship, it sets a precedent.

It says that anyone born with foreign citizenship (& known by the public at large), even IF we assume they were born in the U.S., can be eligible. This would include (but not limited to) anchor babies.

We, and especially those in the military, can not afford to have someone born with foreign allegiance be considered POTUS and thus CinC eligible. It's about upholding the intent of the framers with that requirement and national security (among other things).

Even after he looses, or doesn't run in 2012, we can not afford his precedent to be set/remain. We must not let the state run media, those in academia, or the socialist/marxist's in our midst set this precedent. It has shades of helping to dissolve our sovereignty.

Well, if your time in service predates the UCMJ (roughly 1951), then maybe that's true (although I don't believe it was even true then). There are only a handful of punitive articles that carry with them the possibility of a death sentence. Art. 87 isn't one of those articles.

Art. 85 Desertion, however, is one of those articles, so long as the desertion takes place during a time of war. In the last 80 or more years, only one man has been put to death for desertion, Eddie Slovak, although there have been dozens that have been convicted of desertion.
