Lakins attorney: Conviction certain

Lieutenant Colonel Terrence Lakin, a distinguished Army flight surgeon, is certain to be convicted of disobeying orders, according to his lawyer, Neil Puckett.
LTC Lakin will go on trial December 14 for refusing to deploy with his unit to Afghanistan. The senior officer questioned the legal validity of his orders because they originate ultimately with President Barack Obama, whose eligibility to serve as commander in chief under article II of the U.S. Constitution remains unproven.
Based on the evidence available, his conviction is certain, Puckett told WND. He has no affirmative defense for the offenses he committed.
There is not much left to do in defense of his client, Puckett said. Lakins previous defense counsel, Paul Jensen, already sought discovery of documents, and to introduce evidence and expert witnesses, but the judge shut down all those efforts.
During a September hearing, Colonel Denise Lind, the judge in the case, censored the last remaining arguments Lakin planned to make in his defense: motive and duty. Lakin had intended to explain his motive for disobeying the order and contend that it was his duty as a good soldier to disobey orders that he believed to be illegal.
Lind also rejected defense requests to call as witnesses Ambassador Alan Keyes and retired Air Force Lt. Gen. Thomas McInerney. Keyes was to explain the constitutional issues involved in the case, and McInerney was to talk about the training soldiers receive regarding when they should question and even disobey orders.
Stripped by the court of all possible defenses that might have justified his actions, Lakin has no chance of prevailing at trial.
Lakin had intended, through a court martial, to resolve the nationwide dispute about Obamas eligibility to occupy the Oval Office.
Knowing he was risking imprisonment and dismissal from the service, Lakin deliberately disobeyed his superiors in order to force Obama to produce his birth certificate and documents related to his citizenship status.

If there was a legal system, this kangaroo court would be slapped down immediately. The Judge concluded that allowing Lakin a defense would be embarrassing to the Kenyan. It makes you want to scream. The death of logic has arrived.
It feels like we live in a twilight zone. What’s wrong with America? What’s broken here? How long have we been in a coma???
There was once a time when a military court held under the auspices of the UCMJ was the most fair around. I guess der Fuhrer 0bama and his all to eager to please underlings have put an end to that.

It is obvious that our country has been taken over by an alien force to an unbelievable level. The curtain needs to be pulled back and these wizards need to be revealed for what they are, mere men with an agenda to hijack our country and the world.
It seems to me that this judge, by denying every motion, has opened the way for an appeal.
In fact, there were some who theorized that she was deliberately acting in such a tyranical way in order to provide grounds for an appeal. I have no idea if that is the case or not. But I presume her decision will be appealed.
Meantime, this isn’t going to be pleasant for Lt. Col. Lakin.
Yes, he does but he was denied discovery by the judge. Hussein can't allow his lack of eligibility to make it to any court or the jig is up and he and Nancy and half of congress will be behind bars.

Col. Lakin has not been served well by any of his attorneys.

Yeah, it’s utterly pointless for Denise Lind to waste a military career supposedly in defense of the US Constitution and then go on to deny due process and equal protection rights to somebody who actually DID keep his oath to defend the US Constitution.
I agree; Denise Lind’s military career is totally wasted.
When Congress authorized the “use of appropriate force” they authorized “the President” to use appropriate force, at his own discretion. Nobody else has that authority. Anybody else who tries to implement the use of force without authorization from a valid “President” is acting beyond their authority.
Lind made some really, really blatant errors in her decision, in order to try to justify the abuse of Lakin - including ignoring the elements of Article 92, which Lakin is accused of violating. But by claiming that “the President” is irrelevant to Lakin’s orders because Congress has authorized military officers to give orders, she is absolutely disingenuous, since the orders given to Lakin involve the “use of force” which Congress SPECIFICALLY gave “the President” the sole authority to do.
I think what Lakin’s counsel meant to say could have been said in 4 accurate but disgustingly putrid words: The fix is in.
The military has been taken over by thugs, and I for one am disgustipated.
Eventually the truth will come out.
I think he’s saying the fix is in. When a judge refuses to let you defend yourself against the crime you’re charged with, there’s no doubt that the fix is in and the outcome is certain before you even go into the trial.
This statement could be preparing people for the appeal that will make precisely that case: that Lakin could not get due process because the judge violated his due process and equal protection rights. Which is absolutely true.
He’s saying to Lind, “I know what you’re doing and I’m not afraid to announce it to the world - either here or in court.”
If the military denies Lakin the opportunity to appeal in the civilian courts it will be time to get out our guns in earnest. That will be when the rubber hits the road.
If that happens I plan to be in the streets protesting every day. Lt Col Lakin will become the moral equivalent of the Iranian woman who was shot by a tyrannical regime. Lakin’s brother said he would quit his job and (paraphrasing) raise holy hell, and I’ll be right there with him.
To the Obots and corruptocrats who are reading this: This is not a threat, it is a promise. Make a martyr out of this man and it will be the last thing your depraved coup will ever do to screw the American people, our Constitution, and the faithful military warriors who have put their lives on the line to defend us from lawless thugs just like yourself.
I think most people already know the truth that Obama is a total fraud who is not eligible to be POTUS, and that bureaucrats, law enforcement, and the media have all abandoned the rule of law in order to cover for him.
The problem is it doesn’t make any difference what the truth is or who knows it, because we are not governed by truth or the rule of law at this point. It is a full-out coup. Obama is not socialist; he is Marxist, and now America itself is held hostage to the Marxist regime in power. That is not hyperbole; it is observable reality.
There is no excuse for this defeatist loser statement by Col Lakin’s “lawyer.” This defeatist remark does not benefit Col Lakin in any way.
