Joe Millers thoughts: The political thing to do is concede, the right thing to do is fight
We have to now speak to the hearts of Alaska and the nation, as well as to the mind of the court(s) The fraud card will distract from our primary message, but if we properly follow-up on affidavits and such, fraud will ooze out bit by bit, all to our benefit and to the detriment of the write-in candidate and many other parties. It is a parallel effort, for sure.
Our goal is to win, and that means votes. How we get votes is - rule of law (throw out the misspellings) - hand re-count Fraud may net votes, but its not the primary way to get votes.
Speaking to the heart of the media, Alaska, and the Nation [we need to say] ● something's not right in the election process in Alaska ○ everyone knows it, including the Democrats and left-leaning bloggers, ○ the conservatives and the blogosphere know it
● And everyone knows that at some level the Diebold machines, or those who operate them, are suspect. ○ We have at least one affidavit alleging serious impropriety at the ballot box. ● the only ones who kind of like it are ○ the Murkowski's, ○ the Division of Elections, and to a large extent, ○ the Alaska Republican Party ● it's time someone stood up to this chicanery, and I'm willing to do it, even if I pay a big price.
○ I'm doing it because it's the right thing to do ● The reasons I got in this race are still valid ○ The direction of this country is in a downward spiral ○ The direction of Alaska is on a dead-end road, and I want to remove the grip the federal government has on Alaskas resources, and by extension, their grip on the good people of Alaska ● Many people have characterized me as disenfranchising voters by not accepting the initial outcome of this race
However, I think in the larger sense, the person who disenfranchised the voters of Alaska was Lisa Murkowski, who displayed a serious lack of honor by not accepting the will of the people from the primary, even going so far as to go back on her word to abide by the results
[Heres] What is specifically wrong with this election
This election has been characterized by two things: ○ voting irregularities, and ○ a rush to the finish line to declare victory
Not to mention that I won the primary fair and square in August ○ and Lisa Murkowski failed to honor her own word to accept the will of the people ○ So in a very real sense, she is the one who is dragging this out, and who after spending hundreds of thousands of dollars teaching her supporters how to properly fill out a ballot, now objects when its NOT properly filled out and the vote is challenged.
.. and as a result, we want a hand recount, a level playing field, that removes all doubt about Diebold machines and other irregularities with the ballots ○ see one affidavit with many ballots in the machine when the guy was # 10 in line.
What kind of voting irregularities are you talking about?
Allowing a list of write-in candidates being present in the polling locations then a rush judgment by the Alaska Supreme Court, overruling a lower court ruling that correctly rejected the presence of these write-in lists.
They rushed the election by moving the announced date of November 18 to November 10, giving us a huge challenge in getting a team assembled, trained, and transported to Juneau, where there was no internet connection at the write-in location.
Gail Fenumiai physically rushed from table to table to review contested ballots, and it wasnt until the 4th day that they actually [waited] for our final reviewer to catch up.
Literally, if our final reviewer paused for 5 seconds and lost track of Gail, we would lose track of her and have to catch up. This is no different than a basketball referee not pausing 2 seconds to make sure the two teams were set to play - a simple, commonsense practice of fair play.
This is supposed to be a fair, open and transparent process. Yet the D.O.E. did not allow cameras for the first several days, then they changed their minds mid-stream and allowed photos to be taken.
A Miller advisers message:
There is a law on how the ballots should be counted. That law should be followed. Is it really too much to ask the state of Alaska to follow its own laws? If the laws are followed, Murkowski's lead is substantially reduced, enough where a recount by hand should be ordered.
If there is a hand recount, the over-votes for Lisa should be tossed and under-votes for Joe may be discovered, and we can eliminate the cloud of suspicion regarding the Diebold machines and / or their operators.
The hand re-count is the fairest way to conclude this election, and we feel strongly that it is worth the effort, not only for our campaign, but for the State of Alaska. In the very near future, our case will be heard in state court, although an important component of this case is that the federal court retains jurisdiction.
So we will be arguing that the state law be applied to all of the write-in ballots, and the law simply says that the name must appear as it was written on the candidates declaration of candidacy, as well as the oval being filled in.
We feel very strongly that we will win that case, resulting in over 8,000 votes being rejected because they did not meet the standard as set forth by the legislature.
Once that happens, then we want a fair recounting of the ballots by hand. There is enough doubt in the Diebold machines that the only way to fairly determine the winner is to review all ballots by hand and to apply the law as it is written.
Some very key events occurred last Friday [November 19] when a federal judge reviewed our complaint. He made three key decisions:
[We] got merit on our suit, with very strong language, so therefore the case can proceed at the state level,
jurisdiction remains at the federal level
and most important of all, a stay on the certification of the election !
So, despite the fact that Lisa Murkowski (and the AP) have declared her the victor, this race is a dead heat, and the outcome is yet to be determined.
We feel strongly that a fair accounting of the ballots will result in a victory for Joe Miller. If we didnt feel this way, we would not be pursuing the court action nor the re-count.
N.B. The question Can Joe Miller still win? has a simple answer Yes, but only if the State of Alaska follows its own laws. Joe will fight on, this is not over. Alaskan Freepers please help.
How far ahead is she when adjusted for mis-spellings?
I’m praying every day for The Lord to guide this election.
And I’m thrilled that Joe is not turning into Norm Coleman. Fight the fight.
Anyone wanting to dismiss Miller is either a fool or very misinformed. Anyone that has ever worked the polls realizes the fraud that takes place. This is in most every election and the power of the honest American is being stolen by the Democrat Party, illegal aliens and unions.Lisa Murkowski signed the pledge and lies so who is it to say she would not lie again. We have way too many elitist and people that think they are destined to rule.
This is the type of a representative Alaska desperately needs and should be the goal of conservatives across the nation.
Everybody swears against RINOs in office, by supporting people like Joe Miller you are preventing false representation in office, you have a person elected with firm and decisive goals and most importantly adheres to the laws provided by our forefathers.
The larger the support base for Joe Miller here in Alaska and also from the lower 48 we send the message that we will not cower when faced with odds judged to be superior to our goals, this isn’t just Alaska here, this is a message being sent out all across the nation.
Joe Miller should absolutely win this election, and by winning it legally, not by hiding, not by lies, not by smoke and mirrors. The reason America wound up with a failure such as Obama was because too many people allowed themselves to become lax, unobservant and meek.
An improperly vetted candidate slipped through the process by the manipulations of election laws and with almost no opposition. Joe is fighting for all that is right, and all that is wrong is still trying to find believers that its allright.
We fight! We fight even if the odds are against us, even if its stacked in front of us as multiple obstacles.
We FIGHT because its RIGHT!

And Im thrilled that Joe is not turning into Norm Coleman. Fight the fight.
I just hope he is not turning into Al Gore...
As long as his arguments rest on "this is what the law says, and the law is not being followed", then there's no chance of him being Gore.
“And Im thrilled that Joe is not turning into Norm Coleman. Fight the fight.”
Yup. The bottom line is that you can’t change the rules after the fact.
He has every right to keep fighting as long as he can. However, it might be wiser for him to make peace with Murky and the GOP establishment and wait to take out Begich in 2014. He is still plenty young to bide his time. He could bargain a concession for support in 2014.
Amen! Thank you for expressing this so well.
Keep in mind that Joe Miller is not just a good lawyer, he is also a former JUDGE. I'm praying those years of experience taught him to love and respect good law.
The bitch can do too much damage to this country by waiting until 2014. She has to be taken out NOW!!
