The California Supreme Court decided unanimously Monday that illegal immigrants may continue to be eligible for in-state tuition rates at the state's colleges and universities rather than pay the higher rates charged to those who live out of state.
In a ruling written by Justice Ming W. Chin, one of the panel's more conservative members, the state high court said a California law that guarantees the lower tuition for students who attend California high schools for at least three years and graduate does not conflict with a federal prohibition on giving illegal immigrants educational benefits based on residency.
California is one of several states that permit illegal immigrants to take advantage of lower college tuition for students who attend high school and graduate in state. About 25,000 illegal immigrants are estimated to receive in-state tuition rates in California.

Shocking development in Kalifornia
It seems that after this ruling that out of state students should demand the same rights as illegal aliens and pay only the in-state tuition rate. After all, isn’t equal protection under the law in effect here?

I think the court is saying is that if you are a resident of Pennsylvania who happened to have (illegally) graduated from a California High School, only then would you be eligible for in-state tuition. That’s the pretense of consistency that this court decision offers. Of course there’s no logical reason why someone from Pennsylvania would illegally attend high school in California, but there is a huge incentive for someone who entered this country illegally to get a free high school education in California. And that incentive has just increased substantially with the offer of subsidized college education costs.
Justice Ming Chin, a Pete Wilson appointed Judge was also one we at the ranch voted against this past election cycle, due to his Liberal perspectives. I don’t know at this point if this “Judge” was voted out, or not, but as Californian’s as a rule vote the opposite of Mrs. RQSR, and myself, I’d bet he still rides his pony.
I found the information. Justice Ming Chin was retained by the electorate of California by 62% vote.
California just boggles the mind on everything they do. ILLEGALS should not be allowed in schools or colleges AT ALL.

I’m kind of surprised this case was even heard in California, if the description here is accurate. How can a California state court render a decision on whether a state policy conflicts with Federal law? Doesn’t this case belong in the Federal court system?
Can and will this be appealed?
I will never understand how the “illegal” part doesn’t get them deported. Seriously, if that mindset is acceptable what else matters?
