It seems that after this ruling that out of state students should demand the same rights as illegal aliens and pay only the in-state tuition rate. After all, isn’t equal protection under the law in effect here?

That's the part I do not understand, how can they tell someone from another state that they have to pay out-of-state tuition while undocumented aliens pay in state tuition. Would this be covered by the EQUAL PROTECTION CLAUSE Portion of the Fourteenth Amendment to the U.S. Constitution that prohibits discrimination by state government institutions. The clause grants all people "equal protection of the laws," which means that the states must apply the law equally and cannot give preference to one person or class of persons over another.
