BORN IN THE USA? Officer's brother: 'Obama could have made this all go away'

An attorney-doctor from Kansas whose brother is scheduled for a court-martial says President Obama could, if he chose, resolve the dispute virtually without effort.

Greg Lakin, whose brother is Lt. Col. Terrence Lakin, told talk radio show host Peter Boyles on KHOW radio in Denver that it would be "easy."

"It could have been an easy fix. Obama could have stepped up and done the honorable thing and made this all go away," Greg Lakin said in the interview this week. "Just some type of showing, 'Hey, I was born here … here's some proof.'"

WND reported a new trial date has been announced by the military for Lt. Col. Terrence Lakin, the career Army doctor who decided to refuse an assignment to Afghanistan because of his concern that the orders he was issued in a chain of command headed by Barack Obama were not legal.

According to attorney Neal Puckett, who has represented Lakin since a military judge ordered Lakin could not have access to any information about President Obama's eligibility, the trial is scheduled to begin Dec. 14 and run for three days.

He confirmed to WND that there will be new directions for the defense but could not elaborate.

"All I can really say is the case is going to be handled differently from here on out," he said.

Greg Lakin said he fears the military, which he said never has had to confront the possibility that a president may not be eligible and his orders then may be illegitimate, may take the easy way out and simply lock up his brother.

He could, but he won't. So Lakin is headed for trial, conviction, and probably some prison time.

All military officers are sworn in to uphold and defend the Constitution of the United State of America. If Obama is not eligible to be President by the Constitution, then technically it is the responsibility of all military and government officers to stand up for what they believe is wrong. They should not fear being locked up for hard time like you suggest. Kind of sick.

All military officers are sworn in to uphold and defend the Constitution of the United State of America. If Obama is not eligible to be President by the Constitution, then technically it is the responsibility of all military and government officers to stand up for what they believe is right. They should not fear being locked up for hard time like you suggest. Kind of sick.

Your argument does not hold water. All is based on the assumption Obama is legally qualified to hold office — if he is not the swearing in does not cure the problem.

You can’t expect a guy that makes $400,000 a year, plus expenses paid, to come up with $12.

Actually, Obama doesn't have to come up with anything. All he has to do is let Hawaii know that he waives his supposed right to privacy and allow you and me and anyone else to pay the twelve bucks for our own certified copy.

Lakin is a hero. US military officers are charged with a very complex duty to follow all LEGAL orders...leaving it up to each and every officer of conscience to make a determination of the legality of the orders they receive.

Slavish adherence to illegal orders will not be a defense to criminal behavior.

Lakin is twisting in the wind right now and deserves the prayers and respect of all Christians and patriots.

Obama can’t produce the document and won’t—to Obama one man’s suffering is nothing.

Jim Engle was telling Brett that, "when little Barry Obama was in Idonesia", I almost dropped the channel changer. FoxNews is keeping the illusion alive. The 0 was not Barry Obama in Indonesia, he was Barry Sotero.

I wish Fox would do a little investigating on "little Barry" and his time in Indonesia and explain this little anomaly :

We have a friend who had dual citizenship with Switzerland, when he turned 18 he had to declare one or the other. I only know about this because of the hassle he had when he was trying to get his AF commission/clearances.

Officers also swear that they will well and faithfully discharge the duties of the office in which they are about to enter. How can refusing to obey the orders of three superior officers, missing movement, and conduct unbecoming be considered discharging your duties well and faithfully?

No, it does not. The Manual of Courts Martial makes it clear that it is up to a court to determine if an order is legal, and that individuals make that decision for themselves at their own peril. As Lakin is about to find out.

Jacquerie, you are putting words in other people's mouths. No one here has requested or even desires "a military court to do the job of Congress". We do, however, desire the military court to do the job of the military court. There is no question Lakin willfully rejected the orders of his superiors. The question put before the court is simply this : Did he do so for his own selfish purposes or did he do so because the Oath of Office to which he swore demands it? We already know the answer. This is a precedent setting military case. I pray the court is willing to do what is right, instead of what is easy.

If a sitting President is later found to be ineligible, the usurper can only be removed by the U.S. House of Representatives. That political body has delegated their authority to remove a usurper to the District Court, Washington, D.C. The court action is known as Quo Warranto. The accused MUST prove he/she is eligible to hold the office of the President.
