Ive obtained a copy of an interesting letter that Harvard law professor Larry Tribe wrote to his protégé, President Barack Obama, in the immediate aftermath of Justice Souters announcement of his decision to retire from the Court. I will post a PDF of the letter shortly. [Update: Heres the letter.] In the meantime, Ill call attention, in this post and two or three others, to some of its highlights.
The express purpose of Tribes letter is to urge that Obama nominate Elena Kagan to the Souter vacancy. But before making his affirmative case for Kagan, Tribe argues strongly against the alternative of nominating Sonia Sotomayor:
Bluntly put, shes not nearly as smart as she seems to think she is, and her reputation for being something of a bully could well make her liberal impulses backfire and simply add to the fire power of the Roberts/Alito/Scalia/Thomas wing of the Court on issues like those involved in the voting rights case argued last week and the Title VII case of the New Haven firefighters argued earlier, issues on which Kennedy will probably vote with Roberts despite Souters influence but on which I dont regard Kennedy as a lost cause for the decade or so that he is likely to remain on the Court.

Libs spend their lives trying to self-affirm their own superiority.
So I’d really wonder if ANY of them are as smart as they think they are.
Just now finding this out? Affirmative action has damaged our country.

I'm not saying that all degrees are BS, but a degree sure doesn't mean what it used to.
You’re right...but heck, lib males are secret mysogynists anyway.
“shes not nearly as smart as she seems to think she is”
Unfortunately he wrote that to another person who is not as smart as he thinks he is also.
You can count on me to spot the guys who would be mean to you, Annie....
Nobody is near as smart as he thinks he is.
You’re a dear! R U still in love in AZ?
You betcha!
Grade inflation in the “institutes of higher learning”, affirmative action in academia, and the widespread acceptance of socialism amongst the ‘academented’ - all played a part in the devaluation of American education.
And, your “Bachelor degrees come in 12 packs.” about sums up the sorry situation.

And this wasn’t obvious to the entire world the moment this racist moron opened her mouth and drivel dripped out of it? Not as smart? That’s the understatement of the century. No one in the next 90 years will be able to top that one. She’s a blithering idiot.
:’)
But the next question: is Lawrence Tribe as smart as he says he is?
Ruling Class [snippet]

If, for example, you are Laurence Tribe in 1984, Harvard professor of law, leftist pillar of the establishment, you can “write” your magnum opus by using the products of your student assistant, Ron Klain. A decade later, after Klain admits to having written some parts of the book, and the other parts are found to be verbatim or paraphrases of a book published in 1974, you can claim (perhaps correctly) that your plagiarism was “inadvertent,” and you can count on the Law School’s dean, Elena Kagan, to appoint a committee including former and future Harvard president Derek Bok that issues a secret report that “closes” the incident. Incidentally, Kagan ends up a justice of the Supreme Court. Not one of these people did their jobs: the professor did not write the book himself, the assistant plagiarized instead of researching, the dean and the committee did not hold the professor accountable, and all ended up rewarded. By contrast, for example, learned papers and distinguished careers in climatology at MIT (Richard Lindzen) or UVA (S. Fred Singer) are not enough for their questions about “global warming” to be taken seriously. For our ruling class, identity always trumps.
Well done!
