The can-not/cannot distinction is one of my “pet” annoyances when reading, and all the more unforgivable when I make the error; I don’t know why but it is a little thing that really irritates me.

John Jay in New York wrote a letter to George Washington who was the president of the 1787 Constitution Convention to more than hint that a natural born citizen should only head the Executive Branch of Government. John Jay did not have English common law in mind when he wrote that letter to Washington.

I recollect that John Jay co wrote the Constitution and didn't sign because there was no BOR's....am looking for validation but in the mean time a BBQ is calling so I'll have to pick this up again tomorrow.

John Jay wasn't a delegate to the Constitutional Convention. He wanted to be, but the New York legislature figured that since they were already going to send Hamilton, who was a strong Federalist, they didn't want to send another strong Federalist. Instead they sent two moderates who could outvote Hamilton if it came to it.
Jay did co-author some of the Federalist Papers arguing for ratification after the Constitution was writtten, mostly on the subject of foreign relations, since that was his specialty.
It was the anti-Federalists, most notably Patrick Henry of Virginia, who opposed ratification until the Bill of Rights was added.
