Army gags officer challenging Obama eligibility

FT. BELVOIR, Va. – A decorated military officer who is challenging – in military court – President Obama's eligibility to be president was taken into custody and escorted under guard back to Walter Reed Army Base today after a hearing, apparently so he could not talk to the press or his attorney about his case, according to his defense attorney.

The Army held a hearing today at Ft. Belvoir, Va., for Lt. Col. Terrence Lakin, who posted a YouTube video challenging the Army to charge him after he refused to deploy to Afghanistan again this spring because of his concerns that Obama is ineligible to be president, and orders under his chain of command then would be suspect.

The hearing was on several charges of disobeying commands and "missing movement," and was held by Col. Denise Lind, who has been assigned to be the military judge in the case.

At the conclusion of the arraignment, Lakin was ordered not to speak with the press and was taken back to Reed under military escort, surprising and disturbing a civilian lawyer who has been working on his case.

"This was completely inappropriate. Col Lakin was brought here and taken away from here as if he was a common criminal. He was prohibited from talking to the press for two minutes; he was prohibited from talking to anybody, even me," Paul Rolf Jenson said.

The article at WND is really a good summary, and it bears reading in full. The courts obviously collude with the administration through Holder’s office IMHO, although the article doesn’t say that, its fairly obvious.

Non-Sequitur: Sorry, no. Lakin is charged with disobeying orders of at least two superior officers and with missing movement. Obama's eligibility is irrelevant to that, and in fact Obama could be unmasked as a fraud tomorrow and removed from office and Lakin would still be guilty of disobeying orders and missing movement.

Actually, Brown Deer, you're heart's in the right place, but I believe Non-Sequiter's right on this one from a legal point of view.

A comparison of two famous WWII Japanese Internment Camp supreme Court cases is relevent here. In Hirabayashi v. United States (1943), Hirabayashi protested the legality of internment for an unconvicted American citizen, and lost. But in Korematsu v. United States (1944), Korematsu made the same argument and (eventually) won.

The difference was that in protesting the internment, Hirabayashi disobeyed the orders of the military, while Korematsu obeyed the internment-associated orders and filed suit while interned.

In other words, Hirabasahi refused military authority based on the original wrong, while Korematsu obeyed the original wrong until the court found in his favor.

Basically, this is the same legal argument you and Non-Sequiter are disagreeing about.

In my opinion, the original wrong should have vitiated all derivative "wrongs" as without standing. However, the Supreme Court never asked me what I thought about it. Instead they made what has become a much-studied ruling based pretty much on a declaration of raw power (and a dislike of losing), by the government.

Nevertheless, the ruling still stands, and so it is the way the government, the courts and the military still look at such things. In fact, I'd go so far as to say that the reason the military is cooking up ancillary charges in the present case is so that they can slam-dunk him on non-obedience even if he eventually wins on Obama.

It's not a matter of fairness, but power. The legal profession is simply war by another name.

I am praying that other senior officers stick by LTC Lakin and not let him “hang alone”. If the military doesn’t stick by we the people, we will ALL hang.

IIRC, LC Lakin expects to be convicted in a Court Martial. He intends to appeal all the way through the Military appeals process.
If he is found guilty and dishonorably discharged, and feels that he was wrongfully convicted, he will then appeal through civilian courts...
His attorneys have mapped out a strategy that he knows will cause him hardship. Might even cost him his freedom. I don’t think he is a stupid man.
He is well educated and he has numerous medals for his exemplary service.
The man is a Patriot.

Instead of dissing him, maybe it wouldn’t hurt you for once to wish the man well. I mean...just once. Sometimes it takes a miracle. The right thing at the right time. His attorneys have told him this will give him standing to proceed through this case where others have failed. I pray they are right.
But I don’t think it will be in time to change anything, except maybe when it is all said and done.obama will end up in jail where he rightfully belongs.
Can’t you lighten up just for once?

They’d just wave a print out of a crappy digital image from the internet and call it a birth certificate while drolling that “birthers are kooks” like they always do.

It's taken a couple of years but the scales are beginning to tip in favor of those citizens who have doubts as to the constitutional legitimacy of the president ... citizens the main stream media have attempted to marginalize as "bithers."

Now, hopefully, the heretofore "timid" among the "new" media (certain conservative talk show hosts and other assorted personalities) will be more receptive to investigating and discussing the eligibility issue.
