WASHINGTON (AP) -- Rebuffed twice by the courts, the Obama administration is taking another crack at a moratorium on deep-water drilling, stressing new evidence of safety concerns and no longer basing the moratorium on water depth. But those who challenge the latest ban question whether it complies with a judge's ruling tossing out the first one.
The new order does not appear to deviate much from the original moratorium, as it still targets deep-water drilling operators but defines them in a different way.
"It is unnecessary and shortsighted to shut down a major part of the nation's energy lifeline while working to enhance offshore safety," said Jack Gerard, president and CEO of the American Petroleum Institute. "The new moratorium threatens enormous harm to the nation and to the Gulf region."
Sen. Mary Landrieu, a Louisiana Democrat, said in testimony to the presidential oil spill panel that she was "alarmed" at the Interior Department's statement that its decision is supported "by an extensive record of existing and new information indicating that allowing new deep-water drilling to commence would pose a threat of serious, irreparable or immediate harm or damage to the marine, coastal and human environment." Landrieu said that statement "contradicts testimony given by drilling experts and ignores the history of oil and gas operations in the Gulf."

Texas refineries have a combined crude oil throughput of 4.75 million barrels, equal to 26.8 percent of national refining capacity.
The only reason to continue the harassing disruption of drilling activity is to cause the rig owners to have to either take foreign contracts or huge losses.
Hopefully, the court can dismiss this with prejudice.
Can’t the judge simply issue an injunction then sit on his decision for up to six months after hearing the case? Then the drilling can continue.

Question. If the entire oil industry told the government to piss off, what could the government do? I would love to see some CPA/Attorney in a suit come out to a rig and say, shut it down.

What evidence? If this means that idiots who operate heavy complicated equipment are dangerous, maybe. However, BP are negligent in all respects having blatantly violated at least 19 separate instances of good oilfield practice. In so doing it does not matter what equipment was available, if it is not used right or at all it is useless to anyone.
BP is guilty of gross and willful negligence. This will be proven in the courts and not just by the government but in civil suits as well. Anadarko and MitEnergy will not pay their bills citing gross negligence. BP will not pursue the money because they don’t want the exposure.
BP are also in the process of spin...having negligently created this problem they are now spinning the story to position themselves as heroes for now capping the well...something that should have been done, could have been done at least two months ago. VIRTUALLY NOTHING HAS CHANGED IN THE LAST TWO MONTHS TO MAKE THIS WONDERFUL CAP POSSIBLE ONLY NOW.
Nobody who values their integrity should work for BP. Doing so is like lying down with dogs.
