U.S. to Challenge Arizona Immigration Law

The Justice Department is expected later Tuesday to file its long-expected challenge to an Arizona state law intended to crack down on illegal immigration, two administration officials said.

The law passed in April and set to take effect later this month makes illegal immigration a state crime and requires police to verify the immigration status of people stopped for other alleged crimes.

The Obama administration has criticized the law and the Justice Department's challenge is expected to argue that it infringes on federal responsibilities for immigration, the officials said.

Last week, President Barack Obama again criticized the Arizona law, calling it divisive and "ill conceived," in making his argument for a comprehensive overhaul of federal immigration law.

Feds to challenge Arizona immigration law

Washington (CNN) — The Justice Department is expected to file a legal challenge Tuesday against Arizona’s controversial immigration law, according to an administration official.

The law, which is scheduled to take effect at the end of July, requires immigrants to carry their alien registration documents at all times and requires police to question people if there’s reason to suspect that they’re in the United States illegally. It also targets businesses that hire illegal immigrant laborers or knowingly transport them.

President Obama said in a speech July 1 that the measure has “fanned the flames of an already contentious debate.” Among other things, it puts pressure on police officers to enforce rules that are “unenforceable” while making communities less safe — in part, by making people more reluctant to report crimes, he said.

He said it also has “the potential of violating the rights of innocent American citizens and legal residents, making them subject to possible stops or questioning because of what they look like or how they sound.”

Arizona’s Republican governor, Jan Brewer, has accused the Obama administration of failing to secure the border with Mexico, thereby forcing her state to act on its own.

From The Onion? Man, trying to seperate fact from fiction is impossible with this clown posse in the WH...I didn’t think they would go through with this...do we need any more proof of this Mutt’s intentions?

Citing preemption, the Department of Justice reportedly plans to challenge Arizona’s law on illegal aliens on the preposterous grounds that it will create too much work for our underperforming federal enforcement agencies. Jerry Markon of the Washington Post reports:

“[D]epartment lawyers have been preparing their case, said the sources, who spoke on condition of anonymity because the government has not announced its plans. The filing is expected to include declarations from other U.S. agencies saying that the Arizona law would place a undue burden on their ability to enforce immigration laws nationwide, because Arizona police are expected to refer so many illegal immigrants to federal authorities.”


To make a long story short -— It will create too much work for our underperforming federal enforcement agencies.

Hey, we have about 15 million jobless people ( according to DOL’s impreciswe estimate )... how about deputizing a few million who DO CARE about the country to do actual work the Fed should be doing ?

but also
drops lawsuit against black racists holding sticks outside a voting booth

I am willing to bet my car that if it goes to the Supreme Court, the wise Latina — SONYA SOTOMAYOR will vote AGAINST Arizona.

There is no better reason for Obama to put her in that position other than for issues like this.

If High Chin and Holder were to win this lawsuit, Arizona should IGNORE their win. Then they ( holder and obama) will send in the military to defend illegals at the expense of legal citizens.
What has this country become?

If the Feds upheld their responsibility, then individual states would not be compelled to defend themselves from foreign invasions. But the Feds are guilty of far worse than mere dereliction of duty - they are actively working against those who would defend themselves. That is outright betrayal of the American people.

Is there anyway the state can take this straight to the USSC and bypass all the legal stonewalling by Holder/Obama?

I'd live to see Justice Roberts slap them down before they even get off the ground.
