In the wake of the Supreme Court's ruling on Thursday, every American should be worried when the president of the United States starts threatening the highest court in the land.

Barack Obama’s Justice Department. During argument, the Obama administration’s lawyer, Solicitor General Elena Kagan, made extravagant claims about the extent to which government can censor its critics, outlawing books, movies, and other methods of informing the public.

I recall the Pretender in Chief got all hissy and started lecuring the Supreme Court during the State of the Union. It was on the same issue that this woman argued before the Supreme Court. Bit of payback for ruling against his administration? Don’t rule against me! I’ll show you, I’m sending Kagan back to the court, this time as a justice.

She did this the Solicitor General, no? That is not really damning IMO. She was just doing Obama’s bidding. That is going to be the response to any questions people have of her work during the last year or so.

For starters: Thomas Paine come readily to mind. Dr. Franklin as well.

Now, does ANYONE have any doubts why this radical anti-constitutionalist was selected ??

Although I am against her on the Court, I am sorry to disappoint you concerning Citizen's United [or any other case she's argued since March 2009].

The fact is that she is the Solicitor General [aka the Government's Lawyer]. She is the one that argues on behalf of the government - its her job.

She doesn't select the cases that she is assigned and she doesn't select the position that the government takes in those cases. She is told what the position is [by Obama and Company] - then she has to craft her arguments around it.

The job really sucks - if you accept the nomination [and are confirmed], sometimes you have to argue positions in front of SCOTUS that you really don't believe in.

As an undergraduate at Princeton, Kagan wrote a senior thesis titled

"To the Final Conflict: Socialism in New York City, 1900-1933."

In the "Acknowledgments" section of her work, she specifically thanked her brother Marc, “whose involvement in radical causes led me to explore the history of American radicalism in the hope of clarifying my own political ideas.” In the body of the thesis, Kagan wrote:

"In our own times, a coherent socialist movement is nowhere to be found in the United States. Americans are more likely to speak of a golden past than of a golden future, of capitalism’s glories than of socialism’s greatness. Conformity overrides dissent; the desire to conserve has overwhelmed the urge to alter. Such a state of affairs cries out for explanation. Why, in a society by no means perfect, has a radical party never attained the status of a major political force? Why, in particular, did the socialist movement never become an alternative to the nation’s established parties?...

"Through its own internal feuding, then, the SP [Socialist Party] exhausted itself forever and further reduced labor radicalism in New York to the position of marginality and insignificance from which it has never recovered. The story is a sad but also a chastening one for those who, more than half a century after socialism’s decline, still wish to change America. Radicals have often succumbed to the devastating bane of sectarianism; it is easier, after all, to fight one’s fellows than it is to battle an entrenched and powerful foe. Yet if the history of Local New York shows anything, it is that American radicals cannot afford to become their own worst enemies. In unity lies their only hope."

Justice Kennedy described the law Kagan had defended as an illegitimate attempt to use “censorship to control thought.”

North Korea has judgeships open for people who understand the importance of censorship to control thoughts...

it's their stock and trade...
