Republicans are questioning Elena Kagans ties to a liberal icon and the nations first African American Supreme Court justice, Thurgood Marshall.
In its first memo to reporters since Kagans nomination to the high court became public, the Republican National Committee highlighted Kagans tribute to Marshall in a 1993 law review article published shortly after his death.
Kagan quoted from a speech Marshall gave in 1987 in which he said the Constitution as originally conceived and drafted was defective. She quoted him as saying the Supreme Courts mission was to show a special solicitude for the despised and the disadvantaged.

Kagan, currently the solicitor general, is a former law clerk for Marshall, who was appointed to the court in 1967 by President Lyndon Johnson and served until 1991.
The GOP memo stops short of directly attacking Kagan for her use of Marshalls words, but it offers a preview of the lines of criticism that may come from Republican senators opposed to her nomination. The document also points to Kagans support for a lawsuit against the Bush administrations efforts to deny federal funding to law schools that banned military recruiters from their campus in protest to the militarys Dont Ask, Dont Tell policy on gays.
While Republicans have shown they will be respectful throughout the nomination process, they will also be forceful in asking Elena Kagan whether she will stand with American people or with Obama Dems agenda, pledges the RNC document, titled Strong But Respectful.

I am beginning to wonder if Kagan isn’t a “sacrificial lamb” nomination. Build up a huge sh*t-storm of controversy, then withdraw the nomination and put in another far lefty that would appear more moderate and palatable.

Thanks for posting this. I knew Kagan when she clerked for Abner Mikva. She just about wet her pants when she got the Marshall clerkship. Her views, if anything, are to the left of Marshall. If anyone needs to be borked, it is Kagan.
