W.Va. signs on to lawsuit over federal gun control

A growing list of states joining the legal battle over federal gun control argued Monday that Congress can't regulate guns made and sold within a state.

The argument over gun control, sparked with the "firearm freedoms act" first enacted in Montana and subsequently in other states, is leading to a constitutional showdown over the reach of Congress into state borders.

Seven states, including West Virginia, filed "friend of the court" briefs

I was disappointed when I followed your link to read that my State, Indiana, is not one of the States that has filed a back up brief. I, too, believe that gun regulation belongs to the STATE and not Nancy Pelosi and those crazy nuts that surround her.

Whatever. It's still a law once they sign it. (Referring to state passage of the FFA, not the suit)

Don’t be surprised if Scalia joins the other liberals to find a penumbra that allows the federal government to restrict the 2nd.

If it were up to me, I’d call for a state confab for the purpose of raising a 5 million man militia, with a 10 million man reserve. The first step would be removing the designation “National” from all state guard units.

If congress can decide that intra-state commerce falls within the purview of the commerce clause, as Mark Levin always talks about with the Wickard v. Filburn case, then surely they will assume their power extends to firearms sales for the same reason.

It’s not right but hey - that never stopped them before.

I think there's a new development here, at least it's new to me. Apparently the Firearms Freedom Act is taking a turn similar to the Healthcare Freedom Act. That is, as near as I can tell, Montana has taken the lead in the suit now being joined by other States. I don't know that it would really make any difference but I would like to have seen two to three times this many States joined in the suit, but we'll take what we can get.

The gun dealers in TN are NOT abiding by the ATF. They can kiss it. If it isn’t an outside lines manufactured weapon, Washington can kiss ass.

Thanks BenLurkin. Praying just a hard as I know how for my country. My fear is that we are very nearly at a tipping point. The citizenry will have to make some tough choices in the near future and determine which direction we’re going to go. Pure nanny-state socialism having effectively bought off a large chunk of the population will be painful to eradicate. Especially for we boomers. Are we willing to make the sacrifices that will be absolutely necessary to leave some semblence of freedom and personal liberty for our posterity? We’ll see...

Federal Maternalism has to be confronted and reversed..

From the Grand Canyon to Yellowstone so called National Parks should be managed by and for the benifit of their respective States.. Not as a means to increase the number of federal employees.

The BLM needs to be disbanded as well.. State Lands State Management. Too often the BLM acts like a front organization for international commercial mining interests.
Driving Jackass Miners and Prospectors from making a living from the land.
