An Army flight surgeon apparently is sticking to his vow not to deploy until he is satisfied that President Barack Obama is a "natural born" citizen.
Lt. Col. Terrence Lakin did not report for duty at Fort Campbell, Ky. as ordered today, and a spokesman for the post said it's not likely he will.
Lakin's failure to report essentially dares the Army to bring charges against him for being an unauthorized absence.
Margaret Hemenway, a spokeswoman for a group called the Patriotic American Foundation, which is supporting the 18-year officer, said the Army should not expect Lakin to report unless he sees an original birth certificate showing that Obama was born in Hawaii.
The Army has not said yet what it intends to do about Lakin. Calls to his unit -- Headquarters Company, Medical Brigade, Walter Reed Army Medical Center in Washington -- were not returned by post time.
To this point the Army has ducked taking serious action against the decorated flight surgeon, claiming his public statements and threat to disobey orders did not constitute any punishable offense. On March 31 -- the day after the video was released -- he was given a letter of counseling. In the letter, his commander at Walter Reed warned him against not reporting for duty as ordered.
The orders, Lakin was told, "are presumed to be valid and lawful orders issued by competent military authority." The letter warned Lakin that not showing up at Campbell could result in his facing AWOL charges, as well as missing movement, willfully disobeying a lawful order and showing contempt toward officials. A conviction on any of the charges could mean a dishonorable discharge, imprisonment and loss of all pay and allowances.

Stop with the junior high name calling. He hasn't had his day in court so you don't know which way the military will side. We all understand he swore an oath to the Constitution and not to the President but he hasn't had dis day in court so you don't know which way the military will side. Get over yourself. Just because some don't agree with you doesn't mean they are wrong. No one knows how this will end so just chill.
Lakin has no right to refuse deployment pending a response to his query. Articles 86 and 87, UCMJ apply.
Either way, he’ll have the last laugh because the taxpayers will be paying his retirement for many years.

I am disgusted with Clear Channel and Fox News. When it comes to trust some things are flat out deal breakers. That the conservative media has refused to cover Obama’s eligibility is a deal breaker. I will **never** forgive them or trust them again.

Maximum punishment for conviction of a violation of Article 87, UCMJ.:
(1) Design. Dishonorable discharge, forfeiture of all pay and allowances, and confinement for 2 years.
(2) Neglect. Bad-conduct discharge, forfeiture of all pay and allowances, and confinement for 1 year.
Did you read the timeline of his actions up to this point? He’s been trying to get an answer for the past year by going through his chain of command.
Refusing to deploy will force his command to deal with the issues he’s been raising. Ideally, someone would have addressed his concerns before things got to this point.

I believe that once it goes to court martial, his case is out of the hands of his superiors, and rather up the military courts. He and his backers must believe that the Uniform Code of Military Justice (which is more favorable to a defendant, interestingly enough, than the federal courts, and almost any state court system) gives them a better chance of getting a positive outcome than in the standard federal system.
Perhaps there is some Army judge who has the gonads to allow discovery to proceed for the birth certificate...and they know about him....
Given that something like 40% of the electorate does NOT believe Obama is a natural born citizen--therefore an illegitimate President--the more birther noise that is made, the better--as things like this in politics are corrosive.
There is SOME very good reason Obama has spent well over $1,000,000 in legal fees hiding his original long form birth certificate.
Read the article—as it mentions those. As far as I know though, they were reserve officers, and the military simply revoked the orders...rendering their cases moot.
No one has been penalized yet over the birth certificate—simply because it is a basic fact: Obama has never shown us his original long form birth certificate.
So was LTC Lakin's -- and he wants his day in court, per that very Constitution. Is that okay with you???
or are you afraid that that court might actually want to get to the truth behind these claims of eligibility so that our military can be assured of the legitimacy of their orders.
While I admire and respect all military servicemen/women, the argument that Lakin is acting dishonorably for reasons A, B & C is not valid. About a week ago, a freeper named NathanBedford posted one of the best posts I’ve ever read here, which discussed most importantly what happens when there is no practical public forum in which a cause might find either justice or a fair process. Honorable men must make hard decisions when that time comes, but ultimately the fault lies at Obama’s feet for causing this Catch-22.
I’ll look for the post- I highly recommend it. The chain of command is sacred, but even more sacred (and I do not say this lightly), is the foundation of organized civilization. Colonel Lakin is doing the only thing he knows how to do (firing the only arrow in his quiver, so to speak), to bring about justice.

And no, the military court is NOT going to overthrow Obama for you. You need to stop daydreaming and get your butt out campaigning. Stop giving to support losers like Lakin and contribute to someone who might do something to stop Obama.

If Obama spent a million to keep his long form birth certificate hidden, he’s even dumber than I thought since there is no additional information on a long form that is relevant to his constitutional eligibility. I believe the one million dollar estimate is the figure for total legal expenses related to the 2008 campaign which is 0.015% of the $645 million he raised for the campaign.
Since the state of Hawaii has proclaimed his birth documents to be valid and correct, I doubt that the Governor (a Republican) and the Attorney General (a Republican) and their appointees at the Health Department would risk their careers to falsify documents for Obama.

His short form says that he was born in Honolulu on August 4, 1961 at 7:24 PM and the long form additionally lists the hospital name, the attending physician’s name and signature, and the birth registration number. Under the laws of Hawaii, anything needed for legal reasons that is on the long form must be on the short form and at the bottom of every short form it states: “This copy serves as prima facie evidence of the fact of birth in any court proceeding.”
Hawaii no longer releases the long form to anybody since they went paperless in 2001.
If anybody really wants to see the original, long form birth certificate of Barack Hussein Obama, they should get a judge to issue a subpoena for it which is permitted under Hawaii statutes. That could have been done way before the election in 2008.
