"Birther" Doc a No Show At Campbell
military.com ^ | 4/12/10 | Bryant Jordan

An Army flight surgeon apparently is sticking to his vow not to deploy until he is satisfied that President Barack Obama is a "natural born" citizen.

Lt. Col. Terrence Lakin did not report for duty at Fort Campbell, Ky. as ordered today, and a spokesman for the post said it's not likely he will.

Lakin's failure to report essentially dares the Army to bring charges against him for being an unauthorized absence.

Margaret Hemenway, a spokeswoman for a group called the Patriotic American Foundation, which is supporting the 18-year officer, said the Army should not expect Lakin to report unless he sees an original birth certificate showing that Obama was born in Hawaii.

The Army has not said yet what it intends to do about Lakin. Calls to his unit -- Headquarters Company, Medical Brigade, Walter Reed Army Medical Center in Washington -- were not returned by post time.

To this point the Army has ducked taking serious action against the decorated flight surgeon, claiming his public statements and threat to disobey orders did not constitute any punishable offense. On March 31 -- the day after the video was released -- he was given a letter of counseling. In the letter, his commander at Walter Reed warned him against not reporting for duty as ordered.

The orders, Lakin was told, "are presumed to be valid and lawful orders issued by competent military authority." The letter warned Lakin that not showing up at Campbell could result in his facing AWOL charges, as well as missing movement, willfully disobeying a lawful order and showing contempt toward officials. A conviction on any of the charges could mean a dishonorable discharge, imprisonment and loss of all pay and allowances.

Concur......
This tenacious officer should be revered, not reviled. He is far more deserving of our respect than general”our diversity must not be a casualty” george casey. How silly..

( I firmly believe that the “leadership” of the US Army is deeply concerned about the the next step. If they were on solid ground,LTC Lakin would have have been silenced at the outset. They are painting themselves into a corner and Lakin knows it. He’s no dummy).

The chain of command runs from the President to the United States Secretary of Defense to the combatant commanders of the Unified Combatant Commands. The Chairman of the Joint Chiefs of Staff may transmit communications to the Commanders of the Unified Combatant Commands from the President and Secretary of Defense, but does not exercise military command over any combatant forces.

“This tenacious officer should be revered”

He will be.

“If they were on solid ground”

They aren’t.

The Constitution is or it isn’t. Straight up.

He won’t miss movement (Article 87) until his unit deploys...

The "leadership" in this country only have themselves to blame.

So an Aviation Ordinanceman Second Class with probably l0 years or less in knows more about how military court martials work than a retired LTC? If you are active duty, as your homepage denotes, then everyone on this thread knows you must keep any negative opinions to yourself just as my daughters do.

If they simply discharge him he will get his retirement even if he doesn’t complete 20 years. Back in the late 1970s, there was a huge RIF amongst Majors and senior Captains in the Army. If an officer had 18 years in by the time he was notified, he would get get credit for 20 years and full retirement pay and benefits.

I knew of one Major who had a buddy at the Pentagon and got early notice and was going to be about 30 days short of 18 years. He immediately went on leave for about 45 days and made sure he couldn’t be found until he had his 18 years in.

True story.

I'm not required to keep my negative opinions to myself. I'm just not authorized to post my opinions as an official statement. I'm not in uniform. I'm posting anonymously. "Drew" isn't even my name.

We do have some rights to self-expression.

I think the "bluff" was whether or not the Army would rescind his orders as they did in the past with that other guy.

The other guy was a reservist called to active duty and may have even volunteered; so those circumstances were very different. In this case, it involves an active duty officer.

I was just speaking with a friend of my daughter's, a woman in her 30's on FB about this thread. There are many people in the military for whom it is just a "job" to support them and their family. I don't know if they even think about the implications of the oath they swore when entering the service of our country. In her words,

"... a younger person in the military doesn't think about support and defending against foreign and domestic. And not many people in the military really thinks the president is a domestic threat. he's our BOSS. I've been in for 15+ years and the pres is my boss. There's a lot that I don't agree with. And it has nothing to do with the current pres. We've been deploying for a really long time. And it's not just the current pres who's been sending us out. I'm just saying he's my boss and it's a job! I do what I need to, so that I can support my son and myself. But it's a job for me. A career that I chose to stick with."

It's a pretty sad commentary really.

Posting negative comments on a public forum such as this would be considered an “official statement” for active military. That is the point. You haven’t made any negative comments about this usurper. It is inferred that you support him.

One would think that people who’ve spent years in the military would know that.

If he shows up for work every day, he he can hardly be considered AWOL. Disobeying an order or failing to deploy is another matter.

If they just discharge him, he still gets his retirement since he already has 18 years in. That would be a bit awkward since there is a shortage of doctors on active duty.

There is no additional information on a long form birth certificate that is relevant to constitutional eligibility to be president. The Constitution in Article 2 Section 1 requires the president to be born in the United States or its territories and over 35 years of age. That information is on the Hawaii Certification of Live Birth. Obama’s birth weight, the doctor’s name and the hospital he was born in is not relevant.
Hawaii doesn’t release the long form to anybody since 2001. If you request your “birth certificate” you get the short form. The proof of the unavailability of the long form is the fact that NOBODY has posted a recently issued long form on the internet to embarrass Obama and prove him wrong.
Finally, under the laws of Hawaii, any prosecuting attorney in the nation can seek a subpoena for Obama’s birth documents as a part of an investigation for forgery, fraud or tampering. No one has sought such a subpoena.

Well if I had the opportunity to resign my commission rather than obey what I thought were illicit orders, yes.

The usual affliction among the After-Birther trolls getting it wrong...even the ones who claimed to be career JAG officers.

The Chain-of-Command according to ODH.

Are you really comparing the decision to deploy 30,000 troops to a Lieutenant Colonel disobeying his deployment orders?
If Secretary of Defense Gates, Chairman of the Joint Chiefs of Staff Admiral Mullen or Commander of Central Command General Petraeus didn’t adhere to an Obama order, we’d have something to talk about but not a Lieutenant Colonel.

Obviously, that is NOT what he is doing, so it’s moot.
