WASHINGTON (AP) -- A federal appeals court has ruled that the Federal Communications Commission lacks the authority to require broadband providers to give equal treatment to all Internet traffic flowing over their networks.

WASHINGTON (AP) -- A federal appeals court has ruled that the Federal Communications Commission lacks the authority to require broadband providers to give equal treatment to all Internet traffic flowing over their networks.

Tuesday's ruling by the U.S. Court of Appeals for the District of Columbia is a big victory for Comcast Corp., the nation's largest cable company. It had challenged the FCC's authority to impose so called "net neutrality" obligations.

It marks a serious setback for the FCC, which needs authority to regulate the Internet in order to push ahead with key parts of its massive national broadband plan.


This is a setback I can believe in.

I’m generally OK with the idea of Net Neutrality, but the FCC wasn’t the way to go about it.

While I am a free market capitalist, the requirements to treat all data equally would fall mainly on companies that experience a government-sanctioned monopoly or duopoly. Where I live, I’ve got two choices for broadband: Verizon DSL or Atlantic Broadband cable. I’m very happy with Verizon DSL, but if they started limiting my access to resources, I would only have one other method of recourse. Many have fewer than I do.

You are probably right. Did you catch the news yesterday about Chavez arresting judges who didn’t rule his way? Don’t say it can’t happen here. I’m already seeing things happen that I thought “couldn’t happen here.”

Any time the FCC is limited, it is good. THE FCC IS FOR BROADCASTING, not intertubing.

The solution is not to regulate the monopoly (which is "net neutrality" in a nutshell) but to eliminate it.
