13 STATES FILE LAWSUIT AGAINST HEALTH CARE BILL

Attorneys general from 13 states sued the federal government Tuesday, claiming the landmark health care overhaul bill is unconstitutional just seven minutes after President Barack Obama signed it into law.

The lawsuit was filed in Pensacola after the Democratic president signed the bill the House passed Sunday night.

I agree 13 is not enough.....Mentioning also that states are going to look at the costs to their states to oppose this bill....many are in deep trouble already with cash flow...and they will not be looked at favorably (when the gov. distributions come), should they pursue this with the other states.

The facts are that the bill has passed, the Democrats are in control and won the election. Obama is doing exactly as he said he would do and will continue to push his stuff thru. That is reality....Social Security, and Medicare were also fought thru the courts with no impact to speak of... We still have both. So consider that fact as well.

The possibility of these suits amounting to any if much success is very slim as others here and through out the legal community have stated. Though it's a good show for republicans to take a stand perhaps for a time, the reality is a lot of money will be spent, time and legal haggling which I believe might be spent better otherwise.....

Amnesty is already coming down...cap and trade soon to follow...climate change is not as dead as we hoped. And most of all there is an election soon. So these suits will be a drag on what might be better looking at these other issues we can still do something about.

Better also that the details of this bill that need revising and correcting be done thru the congress even to get a small change in what is coming. Let the republicans we voted for stand there and fight for what can be changed in the bill...while we prepare and get ready to win this next election process.

Just how I am looking at the reality of the situation now.

I dunno. I sense that this bill is different in kind, and that the lawsuits stand a chance of success.

I heard someone on Fox say after all the lower courts, then to appeal to Supremes may take up to 2 years.

Lame article raises more questions than it answers, and does not even mention the legal basis for health care, which is what will be challenged.

Congress is relying on the power to tax and the power to regulate interstate commerce, two old favorites for big government fans everywhere, to force private purchases of health insurance. It's an unprecedented power grab, but to the extent they rely on precedent, the most recent on is the medical marijuana case, Gonzalez vs Raich. Not that the drug war helps to expand government or anything...

Oklahoma voted red in all 77 counties last general election.

Both the state house and senate majorities are Republican.

However, the Governor and Attorney General are both Dems.

So, the AG is undecided whether Oklahoma will join the lawsuit.

The people clearly want to file the action.

The AG is also up for re-election in November . . . developing.

I might be wrong, but that language in and of itself is probably unconstitutional, which may be enough in and of itself to kill the whole bill...

Some states are getting preferential treatment over others (”sweetheart deals”), and certain exemptions in some cases

Hasn't this been upheld (or at least never struck down before) by SCOTUS? Virtually every bill has sweetheart deals. And say they do recognize them as a violation. What next? All it would do is strike that particular handout.

I just don't think this is the best way to attack this bill Constitutionally.
