US states sue EPA to stop greenhouse gas rules [FL, IN, SC, VA, TX, AL...]

At least 15 U.S. states have sued the Environmental Protection Agency seeking to stop it from issuing rules controlling greenhouse gas emissions until it reexamines whether the pollution harms human health.
Florida, Indiana, South Carolina and at least nine other states filed the petitions in the U.S. Circuit Court of Appeals in Washington, D.C. on Thursday, states said.
They joined petitions filed last month by Virginia, Texas and Alabama.
The Obama administration has long said it would attack greenhouse gas emissions with EPA regulation if Congress failed to pass a climate bill.
The state petitions call for the EPA to reopen hearings on the so-called "endangerment finding" the agency issued last year declaring the emissions dangerous to people.
"If EPA doesn't reopen the hearings we will move forward to try to stop them from regulating greenhouse gases," said Brian Gottstein, an assistant to Virginia's Attorney General Kenneth Cuccinelli.
The states have complained that the EPA relied too heavily from reports by the U.N.'s climate science panel which included information that exaggerated the melting of Himalayan glaciers.

If we are to survive, the States are going to HAVE to begin resisting the Federal tyranny. THe Federal Court system, however, will be too slow, and the States have waited too long in most cases, to force the kind of action necessary to end Washington’s overreach. Legislatures will have to take the bull by the horns, start seriously reasserting their 10th Amendment rights, and threaten withholding Federal taxes, expelling Federal officials from states, and perhaps even threatening secession. To those who whine that this is not an option, I say, what other leverage are we left with then?

The supreme court decision to have the EPA regulate greenhouse gasses as pollution under the Clean Air Act is Massachusetts v. EPA. The EPA tried to change its policies to raise the bar for levels of CO2, however this is a clear violation of the law as the EPA cannot just change the content of the Clean Air Act. The EPA doesn't really have a choice in the matter.
As for the other part, I was incorrect when I said the epa had been challanged in court on changing their levels. That hasn't happened yet, but its fairly clear what the decision of the court would be.
Changing the law is still the best way to go about making sure there isn't too much of an impact. The Clean Air act is not designed to regulate green house gasses, and the Senate is going to take up this issue soon as they have climate legislation in the works already.

Part of the healtcare deal with the far left is that a carbon tax bill will be passed, which not only starts up cap and trade, but taxes every transaction of the credits up to 20% of the agreed deal; both the initial sale money and the transaction tax money going to the IRS.
