Update: Hawaii “vexatious” bill “deferred”

(Mar. 17, 2010) — An article by the Associated Press posted today begins with “Birthers beware: Hawaii may start ignoring your repeated requests for proof that President Barack Obama was born here.” The story referred to the public hearing on SB2937,

If passed, the measure would amend the state’s current Open Records Law (UIPA) to allow certain individuals perceived to be troublesome to have their requests for information denied and carry the label “vexatious” for a period not to exceed two years.

The AP also incorrectly stated that “Both Fukino and the state registrar of vital statistics have verified that the Health Department holds Obama’s original birth certificate.” At no time has anyone with the title of “Registrar of Vital Statistics” made any statement about Obama’s records. Rather, Dr. Chiyome Fukino, Director of the Health Department, is the only person to have stated that her department has anything on file for Obama. Fukino also apparently perjured herself while testifying regarding the volume and nature of UIPA requests for Obama’s birth records.

Despite citing Hawaii’s privacy laws on birth records as the reason she cannot release information about them, Fukino has never demonstrated that Obama gave her permission to inspect his file by a “direct and tangible interest in the record,” as required by Hawaii law. Dr. Fukino also has never provided supporting, or “index data,” to back up her claim that Obama is a “natural-born American citizen.” Obama himself also refuses to back up this statement.

Deferred usually means it is DEAD for the session. However it can be resurrected, but this is not the norm.

Then I think we should support the next Republican president when he makes it a habit to pull out a taser in order to deal with vexatious inquisitors who rear their ugly little heads during his press conferences. What’s good for the goose, fair play, what goes around comes around and all that.

This is in direct violation of the first amendment of the United States..... it's our legal right as citizens of the United States.....

I believe that would have been arbitrary determined by the Hawaiian Department of Health. However, the requesters won’t have to worry about that since this legislation looks dead at the moment.

I’m hoping it’s true about the bill being ‘deferred’ ... time to proceed with more vexatious requests ... such as any records indicating that Obama was born on an airplane or ship.

One request would be enough, if somebody else had already asked for it and if you appeal to the OIP when they deny your request. You’d have 2 points against you and that’s all it would take.

I’m glad this bill is dead. But Hawaii should not be allowed to forget what they tried and why they tried it.

Later on today I will be appealing to the OIP the DOH’s failure to respond to my request for publicly-discloseable documents within the 10 business day requirement.

To the request I made that they deleted some of my e-mails from the record, they sent me a request with even my latest responses deleted - asking the exact same thing they had said before, which I responded to in my most recent e-mails which they deleted from the e-mail history.

They’re counting on me not having the money to file a lawsuit. And with Congress a drunken sailor who stole our credit card and no way for me to get it back..... their bet is pretty safe.
