'Very Troubling': Chief Justice on Obama's Court Criticism to Joint Session of Congress

Some firm and unequivocal pushback today by Supreme Court Chief Justice John G. Roberts Jr. to President Obama's court criticism in January.

It is not at all unusual in American history for the executive branch of the federal government (the White House, under the control of either party) to disagree with the judicial branch (Supreme Court).

What is considerably more unusual is for the chief executive of the executive branch (Barack Obama) to look down on the members of said Supreme Court in public at a joint session of Congress and to their faces denounce their independent actions.

And then to receive a resounding ovation from fellow Democrats standing to applaud and cheer Obama as the surrounded justices sat mute, motionless and unable to respond.

That, of course, is what Obama did in his first State of the Union address Jan. 27, objecting to a court decision allowing corporations to donate political funds like individuals as a matter of free speech.

Speaking in response to a law student's question, Roberts said anyone could criticize the court and, indeed, our governmental system of separation of powers encourages such opinionated diversity. Then, the chief justice added:

"I have no problems with that. On the other hand, there is the issue of the setting, the circumstances and the decorum.

"The image of having the members of one branch of government standing up, literally surrounding the Supreme Court, cheering and hollering while the court — according to the requirements of protocol — has to sit there expressionless, I think is very troubling."

The former law school lecturer left much to be desired concerning legal issues in his State of the Union address.

First, in addressing the White House’s signature proposal to date, the President failed to give any assurances that he will expend any effort to force Congress to address the serious constitutional failures of the health care mandates in the existing versions of the legislation.

Second, the President ridiculed the Supreme Court’s decision last week in Citizen’s United as opening “the floodgates for special interest.”

Contrary to the President’s characterization, the decision properly rejected the idea that the government can decide who gets to speak and ban some from speaking at all, particularly those doing their speaking through associations of members who share their beliefs.

Amazingly, he urged Congress to “right this wrong” – amazing because the “wrong” is First Amendment protection of speech rights.

Third, the President claimed that his administration “has a Civil Rights Division that is once again prosecuting civil rights violations and employment discrimination.”

This will come as news to anyone who has followed the Justice Department’s shenanigans in the New Black Panther Party case, one in which the Civil Rights Division chose not to obtain a default judgment to which it was entitled in an open-and-shut case against individuals caught on tape intimidating voters.

Rather than prosecuting civil rights violations, the Obama Justice Department is seeking to evade subpoenas from the U.S. Commission on Civil Rights, which is investigating the incident.

If Obama is serious about showing that his Civil Right division follows and enforces the law, he should begin by fully complying with the Civil Rights Commission’s investigation.”

The conservative members of SCOTUS should be made to wear blue arm bands. As should non-union auto maker executives, bank executives, medical insurance company executives, and all WalMart employees.

I wonder when the window smashings of big banks and big pharma and big insurance properties will occur? Can somebody check the SEIU calendar for the date?

I tink there is something going on behind the scenes, and now more convinced about it

There is something very unnerving about the `false` rumor of Robert’s resignation last Friday too.
They even have a cover story, now, about it coming from the Georgetown Univ. Law School...

I do not believe it. THOERY : I think they had `something` personally embarassing, but absolutely not ethical, on Roberts ... But that Roberts probably told them, if they proceed with any `story`, that the SCOTUS might invoke the certiori (takes 4 justices-Thomas, Scalia, Alito, and Roberts) and hear a birth certificate case. They could issue an order to release the Birth Certificate.

Rahm & THE ONE backed down and created the Georgetown cover story...

I beg your indulgence for the above...but it seems in line with the Massa stuff...

we hear everyday that Pres Obama was educated at Harvard and how lucky we are cuz he’s really smart

wouldn’t you think that either he or his speech writer would have known what he way saying about the case and that they would have got it right rather than wrong

and when it found Pres Obama got it wrong why hasn’t he apologized for it

Well I must say I really don’t agree with Dan Rather I think Obama would make a very good Watermelon salesman but I digress.

The SCOTUS should never attend another Obama SOTU. Obama tried to score political points and got the facts wrong and if he did actually know what he was talking about then he LIED.

So the award of the night still belongs to Joe Wilson.
