(CNN) -- Three police cars pulled into Christina FourHorn's front yard one afternoon just before she was supposed to pick up her daughter at school. The officers had a warrant for her arrest.
"What do you mean robbery?" FourHorn remembers asking the officers. Her only brushes with the law had been a few speeding tickets.
She was locked up in a Colorado jail. They took her clothes and other belongings and handed her an oversize black-and-white striped uniform. She protested for five days, telling jailers the arrest was a mistake. Finally, her husband borrowed enough money to bail her out.
"They wouldn't tell me the details," she said.
Later, it became clear that FourHorn was right, that Denver police had arrested the wrong woman. Police were searching for Christin Fourhorn, who lived in Oklahoma.
Their names were similar, and Christina FourHorn, a mother with no criminal record living in Sterling, Colorado, had been caught in the mix-up.
FourHorn went public about her case more than two years ago, filing a lawsuit that alleged the arrest violated her constitutional rights. The Fourth Amendment protects citizens from arrest without probable cause.

“tell me no, that my son needs 8 weeks of treatment. Excuse me? So you are telling me that in 40 minutes you determined that my son is an alcoholic?”
Hah. He “determined” that he needed to “determine” that people need treatment, or he’ll be out of a job.
(Blood shooting out of my eyes.)
I still say hire a lawyer and get all mention of this wiped from every official record. It could be important later.
That was the kicker, I asked him who pays for this “treatment”? He said that it comes out of my pocket.
All a money grab!
She can sue in this case, but she is suing the tax payer funded police department. Police officers are covered by qualified immunity by law.
They should lift the veil of personal immunity so officers are held civilly and criminally responsible for violating Constitutional rights.
Until that happens,... it is business as usual and no officer has to fear his pension/job when he illegally detains an innocent person.
What is Qualified Immunity?
Governmental officials, performing their specified functions, are afforded qualified immunity from liability stemming from civil damages suffered by others to the extent that the officers actions “does not violate clearly established statutory or constitutional rights of which a reasonable person would have known.”23
Secondly, qualified immunity protects “all but the plainly incompetent or those who knowingly violate the law.”24 Lastly, a federal court ruled that law-enforcement officers are protected from “bad guesses in gray areas” and liable “for transgressing bright lines.”
This is why you have got to check three times before you start making arrests for crimes that you didn’t witness.
And when did that take place?
That's what they all say. I'm sure she was up to something. Otherwise, why would she have been arrested? /s
Welcome to the state sponsored rehab scam. This is a wonderful setup where "counselors" decide what kind of mental adjustment you need and have the courts enforce your attendance.
That's one hell of a business model.
The cops involved should have spent time in jail for contempt of court. They violated a court order.
That is the problem with the cops they are not held accountable by the courts. If a judge has a innocent person brought before them as a defendant that is obviously not the person under warrant that judge should put that cop and the prosecutor in jail for a day or so. They would then get the message that it is not acceptable.
I am about ready to have an aneurysm dealing with these people. It is so blatantly obvious this is a money grab. The dumba$$ admits that he does not have a drinking problem but he could have one in the future!
The problem is people go along with this nonsense. I could write an book on the stupidity that I have witnessed these past few months. I actually have looked up a new state to live in because I do not want any of my money going to pay the salaries of these idiots.
It is not just this but so much more, we as a nation are in a very, very bad state. It makes me physically ill how dumbed down so called adults are. I scream!
"Def(endant) brought in was wrong defendant . . . Go figure!"
≤}B^)
LOL. Close but not quite.
I used to listen to them on the scanner doing the confirmation, and probably more often than not they use tattoos to seal the deal, but with in car laptops now they can also use photos.
I guess that even a blue state can learn from its mistakes every once in a while. Good for them.
