Obama Is Making Plans to Use Executive Power for Action on Several Fronts

WASHINGTON — With much of his legislative agenda stalled in Congress, President Obama and his team are preparing an array of actions using his executive power to advance energy, environmental, fiscal and other domestic policy priorities.

Mr. Obama has not given up hope of progress on Capitol Hill, aides said, and has scheduled a session with Republican leaders on health care later this month. But in the aftermath of a special election in Massachusetts that cost Democrats unilateral control of the Senate, the White House is getting ready to act on its own in the face of partisan gridlock heading into the midterm campaign.

“We are reviewing a list of presidential executive orders and directives to get the job done across a front of issues,” said Rahm Emanuel, the White House chief of staff.

Any president has vast authority to influence policy even without legislation, through executive orders, agency rule-making and administrative fiat. And Mr. Obama’s success this week in pressuring the Senate to confirm 27 nominations by threatening to use his recess appointment power demonstrated that executive authority can also be leveraged to force action by Congress.

Mr. Obama has already decided to create a bipartisan budget commission under his own authority after Congress refused to do so. His administration has signaled that it plans to use its discretion to soften enforcement of the ban on openly gay men and lesbians serving in the military, even as Congress considers repealing the law. And the Environmental Protection Agency is moving forward with possible regulations on heat-trapping gases blamed for climate change, while a bill to cap such emissions languishes in the Senate.

In an effort to demonstrate forward momentum, the White House is also drawing more attention to the sorts of actions taken regularly by cabinet departments without much fanfare.

It’s things like this that make me roll my eyes when people think we actually control our government once they’re voted in.

We are fast coming to the point where we the people have no say in what the government does.

Each succeeding president for the most part retains the work of past presidents as they use them as precedent. The continuing evolution of the imperial presidency. Notice how many executive orders Obama is reversing? Not many at all...

Of Obama's roughly 40 EO's, more than half revoke, amend, or supersede another EO. It's not uncommon for Presidents to play dueling EO's. Here are a few highlights:

One of Obama's first acts was to issue an executive order allowing taxpayer dollars to fund abortions or the promotion of them overseas. The original order prohibiting it had been written by Reagan. Clinton issued an EO overturning it. Then Bush issued an order overturning Clinton's order. Now, Obama's order overturns Bush EO.

Obama also issued an EO that overturned Bush's EO prohibiting embryonic stem cell research.

An Obama EO overturned the Bush EO that established Gitmo.

Obama issued an EO overturning the Bush EO regarding presidential records.

Obama issued three separate EOs on labor union issues, overturning Bush EOs on the same issues.

These are just Obama's high profile EO's. I have no doubt he's been busy overturning many more or, altering them with strategic amendment that changes the initial intent (as he did with his recent amendment to Reagan's EO regarding immunity for Interpol on US soil.)

Typical trick is to stay under the radar by issuing an EO that amends another with eye-glazing language, i.e "shall strike the word 'not' in article 3.1, Section 12(d), fourth paragraph, second line, and, except as provided in 905C, 115D, or 901 of the National Wool Harvesters Act of 1947 (50 U.S.C. 303-5c, 401-5e, and 491-4k), shall insert the word "all" in section 124.3(6-c)preceding the third semi-colon.

Few have the time or inclination to plow through all that and piece it together--least of all, the press. So it's hard to know the extent of what he's really done to date.

How do you spell “domestic terrorism? O-b-a-m-a. Keep contributing money to those running against the Obama agenda, like Marco Rubio and J.D. Hayworth. I would also like to see the Tea Party movement start taking in contributions to get the “Miss me yet? President Bush billboards put up all over our country. Finally, in our own neck of the woods, we need to start pressuring good people like Matt Shea to run against the very liberal senator, Patty Murray. She doesn’t have any formidable conservative opponent campaigning against her yet.

A document recently obtained from the DOI indicates the Obama Administration is considering a flurry of new national monument designations in the near future. The document mentions designations and land acquisitions in 11 different western states: Utah, Montana, New Mexico, California, Nevada, Arizona, Oregon, Washington, Colorado, Alaska, and Wyoming. As many as 13 million acres of land (possibly more) are at risk for potential designation. Coincidentally, nearly every one of these proposed designations involve areas with energy potential.

Designations are declared by the President under he 1906 Antiquities Act. This Act was designed to protect small areas of land and specific items of archeological, scientific, or historic importance which were in imminent danger of destruction. The legislation instructs the President to reserve “the smallest area compatible with the proper care and management of the objects to be protected.” During initial debate on the Act, the argument was whether to allow the maximum designation to be 320 or 640 acres.

President Clinton abused the Act 22 times to designate nearly 5.9 million acres of federal land as national monuments. Many of these designations far exceeded the “smallest area compatible” to preserve the resource and nearly all were designated without any public input or consultation with state and local officials.

One infamous designation was the Grand Staircase Escalante National Monument in Utah. The Utah delegation was not informed of the designation until the day before the announcement. This designation robbed nearly $2 billion from Utah’s schoolchildren because rich coal deposits within the monument could not be developed. It also robbed the State of Utah and Federal government of nearly $315 billion worth of coal and coal-bed methane resources, along with $1.1 billion of oil, gas, and nonfuel minerals.

These designations are just one more example of a renewed War on the West that would public limit access,
reduce domestic energy production, ignore basic property rights, and impede job creation in Western states.

Proposed new designations: San Rafael Swell, UT; Montana’s Northern Prairie, MT; Lesser Prairie Chicken Preserve, NM; Baryessa Snow Mt., CA; Heart of Great Basin, NV; Otero Mesa, NM; NW Sonora Desert, AZ; Owyhee Desert, OR/NV; Cascade-Siskiyou Expansion, OR/CA; Vermillion Basin, CO; Bodie Hills, CA; Modoc Plateau, CA; Cedar Mesa Region, UT; San Juan Islands, WA; Bristol Bay region, AK; Teshetpuk Lake, AK; Red Desert. WY; Alpine Triangle, CO; Upper Missouri River, MT; Pioneer Range, ID; John Day River, OR; Upper Green River Valley, WY; National Historic and Scenic Trails and conolidation of cxheckerboard lands (various states.)
