Attorney Philip J. Berg defends Obama birth certificate lawsuits
Editor's note: Philip J. Berg, former deputy attorney general of Pennsylvania and an activist attorney who brought a lawsuit challenging the eligibility of Barack Obama to become president of the United States, has written the following reply to Jamie Freeze's Dec. 22 RenewAmerica article "Facts are stubborn things: Obama is a natural-born citizen."
Jamie Freeze, a law student, has called any of us who question Soetoro/Obama's citizenship status and constitutional eligibility to serve as U.S. President --- a constitutional right of ours, of course --- incompetent idiots. Ms. Freeze, however, may want to continue her education. Part of being a lawyer, a very important part, is being able to comprehend what you read and to cite the correct law to collaborate it, something Ms. Freeze has clearly failed to do.
I will respond below to Ms. Freeze's allegations. My responses are in bold. I also want to make very clear to all readers that none of the eligibility cases have been heard, litigated, or dismissed based on the law pertaining to any of the issues raised. Instead, the eligibility cases have been dismissed on the basis of "STANDING" only.

Do you know if any court has taken judicial notice of these documents, or of any other documents the legitimacy of which is in question?
If the court is wililng to take judicial notice of contested documents, the fight would be over, it would seem. They are only to take notice of those items which are commonly known and uncontested.
Actually, I suspect that stuff there’s records on is just the tip of the iceberg.

Of major concern is the legal status of any bill signed by an illegal president? I've read analysis by people to whose veracity I cannot attest, that nothing he signs has validity? Then why would such savvy conspirators as Soros, Axelrod, ... etc, use a legally crippled mouthpiece? Was it just Obama’s presumed racial advantage? Did they anticipate Obama’s removal (I think the must have)?Donofrio and Apuzzo focus on the fact of Obama’s birth to a non-citizen. Taitz did the same, but realized, I believe, that few grasped the reasoning and intentional constraints our founders wrote into Article II, and, didn't make it her only injury. Her advantage, and she may be correct, is her passion and the extent to which she can keep the issue in the public eye. Look at the hundreds of Facebook friends in congress and state legislators Taitz has, and ask how many know there is a very potent case, Kerchner v. Obama, winding its way toward the supreme court? If the supreme court doesn't address this, they will become a decoration, like the British Royal family, called on to proclaim here and there, but irrelevant.
Hawaii has been secured. Their Office of Information Practices has failed to make Hawaii's Dept of Health comply with its own laws. Laws are now what the party in power wants them to be. While I don't trust there is anything to show that Obama was born elsewhere than in Hawaii, it is more important that the state can ignore its laws. We are not now a nation of laws. Justice delayed is justice denied, and delays are the order of the day, at least until our justice system has been completely commandeered by the enemies of capitalism.
The move to hide all his documents was remarkable, and very thorough. It apparently required the likely murder of the employee of Obama’s security adviser, former CIA Brenner, suggesting the involvement of the CIA. But we are talking about trillions of dollars, and the weakening of both our economy and our defense establishment. The control could be intra or international. The ‘head fake’ toward a fishy birth certificate seems likely to be a straw dog; create suspicion, occupy the public whom the real conspirators still don't control, and shoot down the birth certificate when enough time has been wasted for control to have been established. It was never the issue, but it served the purpose of allying fears that Obama wasn't qualified. He isn't but for a different reason. That we don't know the allegiance of our commander in chief is precisely why our founders required that the president and vice president be natural born citizens. Biden is surely a natural born citizen, but he is implicated in the conspiracy - and what else can it be when a nation elects president whose passport records, birth records, school enrollment, school papers, senate records, are hidden, and every member of his family who could have attested to his background is dead - the grandmother within days of his election?

I am astounded by the incompetence of the student and practicing attorney who both are oblivious to the fact that Barry’s parents WERE NOT MARRIED at the time of his birth because that would result in a polygamous marriage that would not be recognized by U.S. law. The British citizen, Obama Sr., had a Kenyan wife at the time of the illicit ‘marriage’ of Stanley Ann and Obama Sr. If this fact is determined to be true, then possibly the Family law in effect of a child born pretty much anywhere of a single American woman might take effect, depending on her citizenship status. The question would be whether she was a ‘citizen’ of the U.S. at the time of Barry’s birth.
If they weren’t married, why the Dunham-Obama divorce records? Serious question, no sarcasm intended.

But even this hearsay statement simply says she has seen his vital records, which, presumably establishes his father as a British subject, she somehow proclaims him to be a “natural-born” U.S. citizen.
How is that possible?

I have even less faith in our electoral process than you do, having run for public office myself. But I am quite certain, Obama has no intention of running for re-election in 2012. We will be waiting for him at every DOE office in every state when he tries to qualify again.

Obama told us who is father was. Legally, it is not our problem to prove he lied about that. In case the father is unknown, citizenship of children has been defined in some statues as descending from the mother. But statues cannot change the Constitution, “...in the country, of parents who are its citizens.” When the Constitution was written we didn't have birth certificates.
We had many interesting cases after the Viet Nam War of children born in Viet Nam with American fathers. Here there is no reason not to believe Barack II’s father is any other than who he has told us he was, and polygamy laws are unlikely to make a difference in any case. Having had a polygamous father doesn't negate the fact of Obama having a Kenyan father. Now if it were a child support issue...

Breaking news: Obama a natural born citizen — birth certificate and presidential eligibility issue solved

RenewAmerica’s own Investigative Journalist Jamie Freeze, who, according to her credentials page on the RenewAmerica website, “...received battlefield experience in the war of ideology while attending the University of North Carolina at Greensboro (aka UNC-Gomorrah) (quote). While earning a bachelor’s degree in political science and history, she served as Vice President of the College Republicans and was the lone conservative opinion columnist for The Carolinian, UNCG’s student newspaper. After surviving college without becoming a liberal, she graduated in 2009 and is currently working toward a law degree at Regent University.”
Freeze gained notoriety earlier in her career. At some point she was personally granted an exclusive interview from her deep throat source, “...a Bolivian political analyst with a “...law degree who had worked in the Bolivian Media and government who [at the time was] currently seeking political asylum from the US...and [who had] two assassination attempts on his life [by the corrupt President Morales of Bolivia] ..”. . The scoop was that Hugo “...Chavez has over thirty nuclear weapons that can hit all of the major US cities.” SOURCES: Email dated Sept 30th, 2009 and her RenewAmerica article on the same date “The Ticking Time Bomb in Our Back Yard” , third paragraph).
Freeze: “He validated his story by refering me to other contacts (who I cannot not name due to concerns for their safety). In the interest of journalistic integrity, I wish I could reveal all of my sources, but I cannot compromise their safety...”
Jamie Freeze’s career as an Investigative Journalist is certainly taking off. Again using her “journalistic integrity” and crack investigative and in-depth research skills, has single handedly solved the mystery of Barry Soetoro, a.k.a. Barack Hussein Obama, and has proven once and for all, the “...Stubborn fact...”: “Obama IS a natural born citizen.”
This matter, thanks to Jamie Freeze, can now be put to rest.
In her article, “Facts are Stubborn Things” , posted on the conservative website, she fondly recalls a private conversation she had with North Carolina State Senator Hugh Webster: “In the words of Mr. Webster, “I don’t deal well with incompetent people.” — “At that point, I knew Mr. Webster and I were kindred spirits. I too don’t deal well with incompetent people. As a matter of fact, I go out of my way to avoid them, but when dealing with them is inevitable, I can’t help but point out their incompetencies. As a law student, I am being trained to be meticulous, well-reasoned, and intelligent.”
She goes on to write of her gracious benevolence: “I have been too longsuffering in letting the Birther Movement receive simply a few caustic remarks and jabs from me. It’s time for me to call a spade a spade. Here goes: If you believe that President Obama is NOT a natural-born citizen, then you are an incompetent idiot who is probably watching Glenn Beck while wearing a tin-foil hat. You probably think Obama’s a Muslim too.”
She describes her readers as incompetent: “Obama was born in Hawaii (a U.S. state for my incompetent readers).” [And as for Orly Taitz, Alan Keyes and the rest of us] Freeze continues, “I learned a long time ago that most people are sheep — they’d rather regurgitate something they’ve heard rather than doing their own research.”
“RenewAmerica began in January 2002 as a grassroots support for [1992, 1996, 2000, 2008 presidential candidate] Alan Keyes’ MSNBC TV show “Alan Keyes Is Making Sense...” (RenewAmerica’s “About [us]” page).
“The views expressed by RenewAmerica columnists are their own and do not necessarily reflect the position of RenewAmerica or its affiliates.” This position seems to hold true even against the reason RenewAmerica was orignally founded.
It is sad that Alan Keyes didn’t have the brilliant Jamie Freeze to advise him so he wouldn’t have displayed his apparent ignorance of the law when he brought Berg v. Obama et al., Martin v. Lingle, Donofrio v. Wells, Wrotnowski v. Bysiewicz, Keyes v. Bowen, Hollister v. Soetoro, Cook v. Obama, Barnett v. Obama, and Ankeny v. Gov. State of Indiana, all for the purpose of producing an original U.S. birth certificate and all surely taking thousands of hours of legal research. I am sure if he has read Ms Freeze’s article, he must be in anguish that he hadn’t merely solicited her brilliant baccalaureat legal expertise in the first place.
Orly Taitz has been contacted with the news, so that she can rush out and withdraw her pending lawsuits.
