CIVILIAN TRIALS FOR TERRORISTS IS HISTORIC MISTAKE

Five hundred more people died on September 11, 2001, than died on December 7, 1941.

The earlier attack was against a military installation, the later attack was primarily against civilians. One was in a distant territory, the other was in the homeland, against what had been our first national capital.

One was an act of war, and led to the atomic bombing of our enemy. The other has now been classified a crime, and has led to a civilian trial.

And, most likely, an acquittal.

In a display of stunning disregard for national interest, the Obama Administration announced last week that the architect of the September 11 attack, and four others, were going to be tried as criminals in federal court, given all the rights and privileges accorded American citizens.

It is a decision that history will marvel at in sickened awe. It is the opening of a Pandora’s box of plagues against the United States. It is a significant victory for the Muslim terrorists engaged in an unmentionable war against West, allowing them to reap a second harvest from their butchery of September 11.

It is as if inflicting further damage on the United States and its ability to defend itself was the purpose of the decision.

Here are the reasons Barack Hussein Obama was wrong to do this.

Conviction is unlikely at best. Rules in criminal court forbid any evidence obtained outside conventional procedures. Nothing about these cases is conventional.

The defendants were not caught by police officers, they were not given Miranda warnings, they were not given lawyers, they were not given bail, they were not given speedy trials, they were not given a timely notification of the criminal charges against them, and at least one of them was waterboarded. All of them were exposed to interrogation techniques that are not allowed under American criminal law.

All of that is appropriate when dealing with enemy masterminds caught on the field of battle and subject to military jurisdiction and tribunal, but none of it passes muster in a civilian criminal court.

Consequently, virtually none of the evidence developed against these men can be admitted in court. That makes conviction extremely unlikely.

Further, the civilian court process, and the rights it gives to defendants and their lawyers, will be a deadly tool against the United States. It will compromise military and defense procedures and probably open military, diplomatic and court officials to the potential of terrorist reprisal.

The lawyers for the 9/11 defendants will have the right of “discovery.” That means they have access to all the information – and sources of that information – that the prosecution has. All the paperwork, all the notes, all the videos. From an intelligence standpoint, that will open to public view how our country defends itself – what calls we can listen in on, what groups we’ve infiltrated, how we organize our intelligence and defense forces – and that will be priceless to our enemies.

Though the Obama Administration has declared the words “terrorists” and “terrorism” insensitive and politically incorrect, the fact is that terrorists and terrorism exist, and that ilk will be strategically and tactically benefited by finding out how we work.

And who we are.

And that could be dangerous.

In civilian court, for example, arresting officers are identified. When the names of the American agents who helped arrest the 9/11 mastermind are made public, will they or their families be in danger of reprisals?

What about the folks who conducted the interrogations? Or the folks who sit on the jury or the judge or the prosecutors? The public identification of intelligence, military and legal personnel which is required in a civilian trial will put people at risk.

One of the great follies of this trial is that it will allow a terrorist’s lawyer to put the United States on trial. This trial will be about waterboarding. The condition of a defendant’s detention are fair game in a criminal trial, and there is no doubt that the defendants themselves will sit for days on the stand as their lawyers ask them to recount in detail what happened to them during their years of captivity.

Barack Hussein Obama rose to power on the tide of hatred for George W. Bush, and this trial allows the current administration to once again attack the last administration. It also allows the Muslim jihadists to whip up their supporters and recruits with lurid tales of American interrogations and detentions. Day after day, the world news is going to recount American “misdeeds.”

And that may end up being the worst part of this decision. It will allow the people behind 9/11 to, almost a decade later, recycle their evil to gain a second victory. Terrorism is just a weapon in their war, a means to an end – the domination of the world by Islam – and the publicity of a trial, the platform it will give the terrorists, is another weapon in their campaign. This announcement by the Obama Administration must have been seen as extraordinarily good news by the terrorists.

And by their soul mates in the ACLU and on our college campuses.

But no one who loves America can support this decision. It is just not possible. This decision is diametrically opposed to the interests and security of our country.

It helps our enemies, it hurts our safety.

This has the potential to be catastrophic.

‘’The Military Commissions System, which allowed evidence obtained through torture and coercive interrogation tactics, has been a dismal failure both legally and practically,’’ wrote Patty Casazza, Monica Gabrielle, Mindy Kleinberg and Lorie Van Auken.

The women were among 40 or so relatives of men and women killed on Sept. 11, 2001 and at the USS Cole who met with Obama on Guantánamo policy Friday, along with Lippold.

The White House arranged the meeting to enlist survivors’ support for the 120-day pause in the trials, which they called an attempt ``to fix the quagmire that was created by the previous administration.

I agree with this article. My column, posted last night, lays out five essential negative results from using criminal trials rather than military tribunals. This is an unmitigated disaster.

This NoBama decision has me scratching my head. How could he not see how bad this makes him look??

Which raises the question: Why did he do it?

Obviously, he expects to gain some political advantage from it. But what?

Does he hope to use the trial as a means of attacking Bush and, by extension, Bush's America? Possibly. But I don't quite see how that's gonna work...

It plays to his base. But it infuriates everybody else. What is there to gain...???

And on 11/5, we saw how we are still at a great risk for Islamic teror to come to our shores. This act IS TREASONOUS on the part of OBAMA and KSM’s defense attorneys. This trial will most likely lead to another attack on AMerica, maybe worse than 9/11 and no doubt worse than 11/5. In the days after the final rulling, be very wary.

Anthony Kennedy, the man who obliterated private property rights in Kelo, is the villain who , against the express law of Congress, gave citizen rights to KSM. If unlawful foreign combatants have citizen rights, I am not so sure I want to be a citizen of this country. I would rather have a country that recognizes the difference between civilized people and killer animals. Anthony Kennedy is the real villain here, as much as KSM or any Muslim jihadi.
