ACORN Sues Breitbart: ACORN Falls into Another Breitbart Trap?

Mouse Trap

ACORN CIVIL SUIT MAY PULL BACK THE CURTAIN ON ACORN ITSELF

Remember less than two weeks ago, James O'Keefe dared ACORN to sue?

On September 13, during an appearance on FOX News, O'Keefe, the young independent filmmaker who went undercover with partner, Hannah Giles, demanded an ACORN apology and practically called the tangled web of community organizers "wimps"--or worse.

The independent filmmaker whose hidden-camera videos prompted the firing of four ACORN workers is demanding an apology from ACORN for calling his work a fabricated "scam" and daring the activist group to take legal action against him.

"Bring it on," filmmaker James O'Keefe said Sunday on FOX News. --Filmmaker Demands Apology From ACORN for Claiming Undercover Video 'Doctored'

Today ACORN complied. [It's On! ACORN Sues O'Keefe, Giles And Breitbart]

Was this part of the carefully-orchestrated roll-out of the videos by Andrew Breitbart?

Breitbart certainly seems to have thought this through a lot more thoroughly than ACORN's Bertha Lewis, whose story has changed almost daily in response to a continuing onslaught of damning information.

Breitbart, in BREITBART: The politicized art behind the ACORN plan:

Videos of five different ACORN offices in five separate cities would be released on five consecutive weekdays over a full week - Baltimore, Washington, New York, San Bernadino and San Diego. By dripping the videos out, we exposed to anyone paying attention that ACORN was lying through its teeth and that the media would look imbecilic continuing to trot out their hapless spokespeople.

Back to the ACORN Trap Theory.

“Purely as a rhetorical question, and food for thought: During the time when they were legally “not a legal entity,” could they sustain the harm which is the subject of the suit? I don’t know. Just askin’.”

Great question. I don’t know. Could be that even if harm was found the lack of registration would mitigate the outcome...or the organization would be found to lack standing from the get-go. Thing is, they are so discombobulated over there, I’m not sure they are even aware that they were not paid up. Could be higher up the chain did so.

Last [incoherent] thought: if it is moved to a Federal Court, the case might proceed, but lack of registration could be used as another nail in the coffin of Acorn.

Any attorneys out there?

Been watching Beck since he started on Fox. If I am recalling correctly, early on, he had the main ACORN lawyer on for a live interview. Beck ended up throwing him off the set, and the “lawyer” THEN propositioned one of Glenn’s female producers rather obscenely.
Got to find that. The lawyer was a sleazebag.

The ACORN legal team will include Andy Freeman of the Baltimore firm Brown, Goldstein and Levy ; A. Dwight Pettit; Arthur Schwartz, from Schwartz, Lichten & Bright, PC in New York; and C. Justin Brown from Baltimore.

I remember that Mesta. The oilslick ACORN sleaze called one of Glenn's female producers "Dollface!" and came on to her after the show. Then there was something about an email...can't remember that exactly. Beck was hilarious because he kept mocking the guy for a couple days after that. He'd point point at the camera with both hands and say, "Heyyyyyyyyy, Dollllfacccceee!!!!"

The dude would be nursing himself with some ice even now had he tried that on...:)

It just came to me. It wasn't an email...there was a follow up voicemail to the same female producer in which Mr. Sleazebag berated Beck.

(Don't quote me on it but I think it occurred on the day after the show).

From my understanding there is no case here. The only law busted was them recording sound without the other party being aware. Shucks, that’s a given. So they plead guilty to that charge. What’s the penalty? $500 and court costs?

Andrew and his lawyers know this.

ACORN really must be run by a moronic bunch of loons if they believe the recording issue somehow trumps the discovery of their employees providing information on how to skirt the law while they are receiving federal funding.

At that, that is a Maryland criminal statute. The perp would have to be indicted and tried by the State of Maryland in a criminal case. ACORN filed a civil suit, likely because the DA wouldn't bite.

The same statute was at play in the affair Lewinsky. Linda Tripp was indicted, but the case was later dropped. The statute specifies "interception" of communication without permission, a.k.a. wiretapping.

“Maybe this is giving Andrew Breitbart too much credit? Somehow, I think he’s thought this whole thing out more carefully than ACORN has. “

And it helps when the average I.Q. of an ACORN member is about 78.

I’m confused. This is a civil suit.. I read the earlier link about linda tripp and the interception statute. Why would statutes fall into play in this case? Are the attorneys that stupid, or is there another agenda?

This is starting to remind me of cases where burlars sue homeowners for being shot while in the process of theft.

I think these are “slap” suits to scare OTHERS from exposing acorn.

We need to have SO MANY PEOPLE EXPOSING ACORN that they can’t possibly attacks us all.

ACORN=Obama.
