From my understanding there is no case here. The only law busted was them recording sound without the other party being aware. Shucks, that’s a given. So they plead guilty to that charge. What’s the penalty? $500 and court costs?

At that, that is a Maryland criminal statute. The perp would have to be indicted and tried by the State of Maryland in a criminal case. ACORN filed a civil suit, likely because the DA wouldn't bite.

The same statute was at play in the affair Lewinsky. Linda Tripp was indicted, but the case was later dropped. The statute specifies "interception" of communication without permission, a.k.a. wiretapping.

I’m confused. This is a civil suit.. I read the earlier link about linda tripp and the interception statute. Why would statutes fall into play in this case? Are the attorneys that stupid, or is there another agenda?

This is starting to remind me of cases where burlars sue homeowners for being shot while in the process of theft.
