ACORN to retrain workers, sue filmmakers

ACORN took action Wednesday to repair its image after two undercover bloggers posing as a pimp and prostitute videotaped some of the organization's representatives apparently assisting the pair in sex trafficking schemes in San Bernardino and three East Coast cities.

"As a result of the indefensible action of a handful of our employees, I am, in consultation with ACORN's Executive Committee, immediately ordering a halt to any new intakes into ACORN's service programs until completion of an independent review," said ACORN CEO Bertha Lewis, in a statement. As it looks internally, ACORN is also planning to sue the bloggers for illegally recording ACORN employees without their knowledge, California ACORN officials said.

I think ACORN would have a better case if the filmakers had gone to the interviews in “black face”. ;*) (no that smiley face is not Rep. Waxman, CA)

I doubt that this supposedly 501C corporation has a leg to stand on with regards to bring suit against O’Keefe and Giles. I think any reasonable judge would throw this out of court.

I think your experience is the norm...but it doesn’t always work that way.

My hubby, a long time corporate lawyer, was called to FEDERAL jury duty. Not only did he end up on the jury for a FIVE WEEK TRIAL!!, he knew the lawyers on BOTH sides...and he ended up being the foreman of the jury.

Unwinnable. Does not apply to a public/semi-public area, i.e.; no 'expectation of privacy'. Such a lawsuit would be dismissed before it was even fully introduced in court.

I have a question for any lawyers or any students of the law who have real knowledge and experience in these matters.

Everyone keeps saying ACORN will never sue because they would be afraid of what could be exposed during “discovery”.

But if all they are suing for is being “illegally taped” would they have to expose anything that doesn’t pertain to whether they knew they were being taped or not? In other words, if they do not claim they are being falsely acccused of anything, would evidence of their various corrupt activities even be relevant to the lawsuit? Wouldn’t the only thing the defendants have a right to “discover” is whether ACORN was informed that they were being taped?

Again, if ACORN sues for slander or defamation I could see how evidence of their wrongdoings would be relevant. But if they are only suing for being illegally audio recorded without their knowledge, which is against Maryland law, would they have any reason to fear “discovery”?

Me too. I’ve been called 4 times in the last 5 years nd each time as a white married woman I am dismissed. I guess if you want to serve you can’t open your mouth and let them see that you can think for yourself. The group they chose to serve looked like they were lucky that they were able to dress themselves that morning!
