This needs to spread far and wide. It isn't the end-of- life counseling, it is the comparative effectiveness research that will seek to limit end-of-life care.

Everyone keeps referring to section 1233 of HR3200 and “end-of-life” counseling when talking about “death panels” and rationing.
You have accurately identified the real source, section 1401,of the “death panel”/rationing issue.
Evaluation of “Comparative effectiveness” as outlined in that section by “payers” looking for “value” will surely lead to rationing and denials.
