Shocker! Judge orders trial on eligibility issue

A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.

If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.

In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.

In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent defendants Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party's chairman, were restored as plaintiffs.

But the judge did not immediately rule on Taitz' motion to be granted discovery – that is the right to see the president's still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz' challenge to the work of a magistrate in the case.

I really would like to see a SCOTUS ruling on what NBC is in the USC.

Yes, a ruling which will clarify this once and for all. This is a very serious issue which is related directly to national security.

I know Obama is a radical communist Muslim and I have my doubts about his citizenship, but he did not make a slip in the sentence of that speech.

Remember his slip of the tongue when he told Stoopidlis about his muslim faith!!!

2) Needs to follow them and quit talking when she is not supposed to talk and remember the judge runs the court

I think that maybe is her strong point. She is persistent like a pit-bull with lipstick and not intimidated by the judges. She has taken this issue further than any of her many male colleagues!!!

What would you say if a Kos kid who tied to present this in 2001:

Being the typical KoS kid, he would be 'tied' up, spanked, and sent to bed without any dinner, nor would they be allowed to watch 'The Mighty Gore' on the Cartoon Channel.

Nice try, no cigar.

Because I think she's an inept boob.

She alone has brought this issue further than any of her male colleagues. You could help her out with a $50 bill, I have!!!

What amazes me is that Jim Robinson seems to not cared that NS is such a deceicer/liar working to dissemble and deceive and foment anger at FR.
***Cheer up, things are improving. A few months ago, JimRob told me and LJ to stop hunting CoLB trolls. It looks like you’ve been given a free pass, so... happy hunting.

We got the mods to come full circle on Star Traveler, maybe they’ll see the light with NS.

Appreciate the ping! As Representative Davis stated, states falsify BC documents all the time, when adoptions take place. Won’t it be interesting to find out what is in the HI vital records, since Lolo adopted Barry in HI and renamed him Barry Soetoro, as attested to by Stanley Ann’s pleading in her divorce from Lolo in 1980!

The Government asked Carter to dismiss the case on Friday, and he didn't do it. The government lawyers didn't say we will wait until October 5th. *snicker* They wanted him to summarily dismiss the case as soon as possible.

You truly are clueless about the process. The opposing side has the right to respond to a motion to dismiss. The government had no expectation that their motion would be granted on Tuesday. And I'll also point out that the judge could have denied their motion on Tuesday, as he did with all three of Orly's, but he didn't do that either. If your quote is accurate and the judge said such motions seldom if ever are granted then why didn't he do that? If he was so contemptuous that he hadn't bothered to read it, as you seem to believe, why didn't he toss it along with Orly's frivolous motions? Especially if, as you believe, he wasn't going to give it any thought anyway?

How about we put it to a FR vote who is more clueless you or me? I vote YOU. 1 to zip!

(*yawn*) And I vote you. Tied.

And the Gooberment lawyers played games until Carter told them to except it not make silly excuses.

You haven't read any of the transcripts or the orders that have been printed or issued in this case, have you? Why not, they're all available out there? Instead you post from total ignorance, which is no doubt the state you feel most comfortable in. You really are clueless.
