With a scheduled hearing date looming Tuesday, Lucas Smith, the man who tried to sell an alleged Barack Obama Kenyan birth certificate on eBay, has filed court papers in a high-profile eligibility case insisting – under threat of perjury – that the Obama birth certificate in his possession is the genuine article.
Smith filed his affidavit through California attorney Orly Taitz, who has spearheaded several lawsuits challenging Barack Obama's constitutional eligibility to serve as president, as part of a case that includes as plaintiff former presidential candidate Alan Keyes.
Taitz posted on her blog Smith's declaration, which claims he obtained the alleged birth certificate from Coast General Hospital in Mombasa, Kenya, and insists it's real.
"The true and correct photocopy of the birth certificate obtained is attached to this affidavit as Exhibit A," the declaration reads. "I declare, certify, verify, state and affirm under penalty of perjury under the laws of the United States of America that the foregoing statements of fact and descriptions of circumstances and events are true and correct."
Smith's affidavit, which includes a copy of the certificate, has been filed with Judge David Carter of the U.S. District Court for the Central District of California. Carter is scheduled to preside over a hearing on the case on Sept. 8.
Taitz told WND she believes the swiftly approaching court date prompted Smith into action:
"He has been in touch with me for quite a while, and he emailed me the document with his signature," Taitz said. "I think he was trying to figure out the most expedient way to bring his message public, and maybe he felt that because I have a hearing coming, that would be the most expedient way."

You are right. The only way to prosecute him for perjury is to prove his is a fake and he knew it. The only way to do that is for Obama to produce his real, certified Hawaiian, long-form birth certificate, and that he’ll never do.

People should be held accountable if it’s true. It is an assault on our constitution. Remember when Schwarzenegger took office in CA? People were quick to point out that as Austrian born, govern(ator) was as far as he could go. On the other hand, what then? Biden? Another election? And it could be as he says, he was born in Hawaii, and he feels addressing it over and over only casts dispersions instead of removing them. But Kenyans seem equally convinced he’s one of theirs.
Of course, there would have to be an evidentiary hearing first to determine the document’s authenticity. I’m afraid the Court is going to want more than just a purloined, stamped birth certificate to form the necessary predicate to force Obama into responding to this “evidence”, like the Kenyan notary who placed the notary seal on the document, Kenyan hospital officials, et cetera. There is also a chain of custody issue that will probably take years to sort out.
I am sure the conscience of the Court will be shocked if this document was seriously offered as evidence in Tuesday’s hearing.

Only a dipsheet compares the lunacy of Bush/Cheney bombing the WTCs and the FACT that the marxist punk has yet to cough up his birth certificate.
He is committing himself to a serious course of action; his original action of selling on E-Bay was also one, since he could easily have been brought up on criminal fraud charges if a sale had gone through with a large final sale price and the document then turned out to be a fake. It's not unknown for people to undertake bold fraud, of course, but he is showing a persistence that doesn't tailor well with just simple fraud, where generally the fraudster avoids publicity rather than seeking it.
I am very curious to see how all this plays out. I would also very much like to see any similar document from this hospital.

There are many lawyers and armchair quarterbacks out there who do nothing but sit around and bloviatate, tell us what great lawyers they are, what SHOULD be done- and attack Dr. Orly Taitz. If they are so great, why don’t they get out there and DO something? Where are their clients? Where are their lawsuits?
They condemn Dr. Orly for refusing other lawyer’s help. They laugh at her and ridicule her for her ‘mistakes’. Is it any wonder she refuses their help?
And maybe, just maybe, she doesn’t want another attorney in on her work because she fears him hogging the glory when the usuper is brought down- as the egocentric, bloviating Leo Denofrio would surely do. I don’t blame her one bit on this!
Dr. Orly has put her life’s blood into this fight. SHE HAS MADE DEFENDING THE CONSTITUTION AND THE AMERICAN WAY OF LIFE A PERSONAL AMBITION, IN THE ABSENCE OF ANY CONSTITUTION LEADERSHIP FROM COWARDLY REPUBLICANS AND THE SCOTUS.
Dr. Orly is the ONLY one out there in the trenches EVERY day hitting Obama on multiple fronts and trying to bring him down. It is reported that she is more than $8,000 in debt from using her own funds for expenses in her flights across the U.S for interviews, speeches, serving papers and meeting with officials.
She has even gone to Isreal and Russia to spread the message about Obama’s inelgibility!

Sure, Dr. Orly makes mistakes. We all do. But Dr. Orly is no dummy. How many of us could go to a foreign country, learn 5 languages, establish a successful dental practice, a successful real estate business AND pass the California state bar- one of the hardest in the U.S. to pass?
She may be a ‘mail order’ attorney and not a Harvard lawyer, but she IS an attorney with all the rights and privilages of a Harvard lawyer nevertheless!
The point is; she has the passion, the zeal, the courage of her convictions and the love of America and its freedoms (unlike many of our ‘great’ attorneys and ‘patriots’ who criticize her) that will not let her give up!
She is exhausted. She is nervous. She is frustrated. It is reported that she gets by on 4-5 hours of sleep per night, and her family is very worried about her health- as well as her safety.
She makes mistakes. But she will NOT give up. She will keep on until she gets it right.
So let’s get behind this great little Russian refugee and great American patriot.

Well. I’ll be. We agree upon something.
President with Constitutional disability, Vice President becomes acting President. Not qualified or hampered by procedural requirement in any way .. just, boom, no longer President.
Isn’t this all about discovery? WND was one of the first which said it was a fake/fraud....Mr. Smith realizes this is perjury therefore he would not have ever taken these steps if it was a fake.

No...that's not the way it would work because the election of 2008 would be illegitimate. McCain/Palin may be sworn in after a brief (1 month) interim POTUS (could be Pelosi, as painful as that would be).
