ATF to Tennessee: We're Above Your Law
Examiner.com ^ | 07/17/09 | David Codrea

Posted on 07/17/2009 5:55:50 PM PDT by Copernicus

The ATF - as expected - has issued a letter in which it disregards the 10th Amendment restrictions on federal power (as seems to be the trend since the late 1930) and has notified Tennessee’s federal firearms dealers that the Tennessee Firearms Freedom Act is meaningless. Essentially, ATF is saying to the state of Tennessee that the 10th Amendment no longer exists.

We expected such from a tyranny that no longer lives within the bounds of its express authority…

“State’s Rights effectively ended when Woodrow Wilson
rammed through the direct election of Senators.”
- This is wrong

FOR EVERY WRONG THERE IS A RIGHT.

IT CAN BE FIXED - one way or another.

bureaus that should be disbanded?
How about 50 percent of ALL govt agencies should be disbanded and its employees sent to re-education camps where they learn to actually be productive members of society instead of leaches?

I was thinking more in terms of 75%!

And you're absolutely right. They will need re-education as most held government jobs where only two items could be found on their desks: both shod feet!

All jobs in our military should be performed by uniformed military personnel. No more civilians in the Army, Navy, Coast Guard or Marine Corps.

While in the Amy we held high esteem for two types of officers,
West Point Grads and Warrant officers.
All others were usually a joke.

If the Second Amendment don't apply to the States
http://www.nraila.org/media/PDFs/litigation/NRAAmicusFinal.pdf

Then neither does the {commerce clause} and any Federal Gun law that stem from it!

These Government[s] have forgotten that ALL authority rest in {The People}-Sovereign-I may add..

Nunn v State of Georgia, 1 Kelly 243 (1846) Nor is the right involved in this discussion less comprehensive or valuable: "The right of the people to bear arms shall not be infringed." The right of the whole people, old and young, men, women and boys, and not militia only, to keep and bear arms of every description, not such merely as are used by the militia, shall not be infringed, curtailed, or broken in upon, in the smallest degree; and all this for the important end to be attained: the rearing up and qualifying a well-regulated militia, so vitally necessary to the security of a free State. Our opinion is, that any law, State or Federal, is repugnant to the Constitution, and void, which contravenes this right, originally belonging to our forefathers, trampled under foot by Charles I. and his two wicked sons and successors, reestablished by the revolution of 1688, conveyed to this land of liberty by the colonists, and finally incorporated conspicuously in our own Magna Charta!

Hear, Hear, they’re no better than King George.

It's a great example of "Swapping one tyrant, three thousand miles away for three thousand tyrants, one mile away" (or similar quote to that effect). Our founders were well aware of the potential for elected leaders to steal or negate our rights.

My hope is that the Governors of all 50 states, or 57 or 58, would band together and flatly tell the Feds that if they persist in ignoring the laws and sovereignty of the States, they they will collectively revoke the peace officer status of all federal officers in their states, and they will issue executive orders directing their own sworn officers not to cooperate in the locating, apprehension, transportation, incarceration, prosecution or extradition of persons detained by federal authorities, if the persons being detained are exercising rights granted them under State laws.

This of course would make the liberals heads explode. Tough. They didn't have any problem when State and local agencies refused to cooperate with the Feds where the round up of illegal aliens was concerned.

Now after reading that book, the ATF is probably monitoring all of the rod and gun clubs in the USA as possible “shadow militias.” That’ll keep them busy.

Article VI, s2: "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding."

Only if these {newly} passed laws/treaties are Constitutional.

Yes, of course. I was reacting to the Tenth Amendment cites, because most X quoters ignore Article VI.

Well, my gun club president mentioned something similar.

See, membership is up almost 300%, and most of the new members have the scary black guns (some of us regular members go new shiny scary black guns).

Funny thing is the local Sheriff is a member, and recently opened up concealed carry permits to “Demonstrated Responsibility” after years of “need based”.

Believe me, the recent surge of guns and ammo have some in high places very, very worried.
