Oklahoma resident and Plaintiff pro se Steven L. Craig has been pushing a little-known case through the American Judiciary wherein he is petitioning the United States government that the lack of a natural born citizenship definition combined with Congress unwillingness to specifically define the term should lead the Court to grant [a]n immediate Order of Declaratory Judgement expressing Courts Opinion of the Constitutional and Legal Definition of Natural born Citizen.

Huh? This is in the 10th Circuit and is awaiting SCOTUS conference on 9-29-2009. Confereence means at least 4 justices are needed to move it forward.
It looks like it is a case to define what citizenship is. Is the 10th Circuit is Oklahoma and neighboring states???

Asking the courts to legislate from the bench doesn’t seem like a good idea to me.

I think he is asking SCOTUS to clarify, interpret or define not legislate.

This guy argues that it is the responsibility of Congress to define “Natural Born Citizen”. He clearly sees it as a legislative function.
He further argues that Congress has not performed its legislative duty. As a result, he wants the Judiciary to perform what he admits is a legislative function.

I’ve gone over 5 or 6 SCOTUS decisions from 1870 to 1952 and they do know what a natural born citizen is. SCOTUS does differentiated from native v. natural born.

Unfortunately - I think it is Congress job to verify that O was eligible because the state elections director punted on that role in the election and it appears to vague at least in Hussein's case but others it was not vague.
On you second statement; I view it as a plea to the judiciary to check the power of the legislative branch that has FAILED in their duty. We have three branches of govt that are supposed to check the other’s powers. the citizen cannot go to the Executive because he is part of the fraud. The Legislative is obviously derelict in their duty and this is a plea to the Judicial branch to do their JOB.

It does seem that defining "natural born citizenship" is interpretation of existing law.
How could it be legislating as others are expressing on this forum?

The parties were supposed to ensure that their candidates were qualified (Sec of State of California. They failed to do so.
The Sec of State were supposed to ensure that persons being placed upon the ballots were qualified. They failed to do so.
The electoral college failed to check qualifications.
The congress approved the election result without pursuing the qualifications.
Various courts failed to stop the process and decide for upholding the qualifications requirement even when cases were brought asking them to do so.
When no one steps up, it is the responsibility of the people to do so.

My view is we have three branches of govt - Executive, Judicial and Legislative. the law appears to be fairly clear but no one is enforcing it. Legislative has been TOTALLY derelict in their duty. He is executive and he is ignoring and using lawyers to cover it up. The public's plea is to the judiciary who appears to be ignoring the public. The state courts appear to not have jurisdiction except maybe Hawaii. The lower federal courts and Dept of Justice appear to be totally corrupt. This leaves SCOTUS and it appears they are either waiting for the right case or they do not have the courage. Or they are waiting for the public to start to turn on him enmasse before these cases finally get heard. The fourth possible branch of govt which Leo Donofrio I think said he found in Justice Scalia's writings is the Grand Jury. This is what these grand juries are attempting to do but I am not sure where that will go.
