Palin defamation suit could cost Moore thousands in legal fees
Examiner ^ | July 6th, 2009 | Martha R Gore

If Sarah Palin decides to go ahead with a defamation suit against blogger Shannyn Moore, who wrote that the Governor resigned because she was under criminal investigation, it may give others who have been defamed the courage to go after other bloggers who can be accused of "malice" in creating unfounded rumors about them on the Internet.

Should Palin sue Moore, it could mean thousands of dollars of legal fees in order to defend herself. It might send a message to other bloggers who can be accused of using "malice" in defaming public figures. (See an explanation below.)

Palin's attorney has already issued a statement accusing Moore of "false and defamatory allegations" in writing that Gov. Palin resigned because of an alleged investigation pertaining to the construction of the Wasilla Sports Complex.

On July 5, 2009, the Feberal Bureau of Investigation (FBI) took an unusual step of making an announcement that Palin was not under any kind of investigation. It said,

"There is no truth to these rumors out there in the blogosphere."

If Palin decides to make an example of Moore and files a suit against her, by the time the blogger finishes trying to defend herself, even if Palin does not get a judgement against her, the costs can run into hundreds of thousands of dollars.

No doubt about that... although they might reconsider propping up a total tool if it fails.

Do it. It would be a sign of grit, determination and perserverance. Justice in the face of oppression.

I hope she does. It would be a nice way to pay for the hundreds of thousands she had to spend to defend herself from frivolous ethics complaints.

As I explained to my uber liberal friend - if shes such an idiot then you have nothing to fear. The reason they keep going after her is fear.

Defamation is an intentional tort, not covered under any homeowner’s or umbrella insurance policies. Insurance companies have no duty to defend. All costs of defense would be borne by the defendant. Even if she were entitled to summary judgment, a plaintiff’s attorney can still “discover” them to death financially before you even get to a summary judgment hearing.

I’m all for free speech, but remember that free speech is only (technically) a protection against the government, not against any consequences you put on a private individual. Now that Sarah Palin is a private citizen, she should consider legal action against her critics when they go too far.

Looks like Shannyn might be tied up in court for awhile and have little time for blogging.

Perhaps so. But Soros can't cover the time she'll have to personally put into defending herself, or whatever stress results from defending a justified legal action.

I wonder if the speech is labeled fiction.

Like Ron Howard losing his hair to to AIDS. Its not a lie, its just “fiction” (the same way he defends his crap movies)

Don't forget that this would not be free for Sarah. She will spend thousands to lawyers herself.
