Arizonans will get a second chance to decide if they want residents here to be able to opt out of any national health insurance plan approved by Congress.
Without debate, the state Senate on Monday voted 18-11 to put a proposal on the 2010 ballot that would constitutionally override any law, rule or regulation that requires individuals or employers to participate in any particular health care system. The House already has approved the measure.
HCR2014, if approved by voters next year, also would prohibit any fine or penalty on anyone or any company for deciding to purchase health care directly. Doctors and health care providers would remain free to accept those funds and provide those services.
Finally, it would overrule anything that prohibits the sale of private health insurance in Arizona.
The push comes as Congress is debating the concept of some sort of national health insurance plan, a plan that foes have equated to the national plans of Canada and Britain.

Let's see if the people in those states do the same. Here in the People's Republic of New York, I have no such illusions that the comrades would do anything but overwhelmingly defeat anything that stands in their way of suckling on the "free" health care teat.

Upstate NY needs its own state.
It’s high time states refuse to follow any mandate by D.C. that is not specifically granted to the federal government by the Constitution. The Tenth Amendment needs to be put in effect immediately by the states or they will be crushed under the load of debt leveraged by the spend-thrifts in Congress.
One can only hope more states will do the same—GA included.

Bolick is a talented jurist. Just as we have the right to earn a living, he will make a fine argument that we also have the God given right to choose with whom we do business, ie contract to receive health care.
Of course, convincing judges who never heard of the Natural Law foundation of our Constitution and subscribe to the "living and breathing" nonsense is another matter.
How do you read this as standing up to a challenge that goes to the SCOTUS?

I agree it would be nice to see some other state legislatures passing laws that contradict the federal government. It is high time for a showdown over the Tenth Amendment and I think the court with Kennedy in the middle might be inclined to rule for the states (JMHO)

I like the idea, but see the probability that the feds will suck the money out of the state anyway and send it to NY, California, etc....

Sure, as long we can jettison Buffalo, Rochester, Albany, Syracuse-Ithaca-Binghamton and the extreme north:

Not going to fly constitutionally, each with the present SC.
But it would be interesting experiment to see how many uninsured would opt to remain so if they could obtain insurance by moving to another state - pretty tough for example if you are unemployed, or a low-wage job without insurance, not to look for options to provide health insurance for your family.
And downstate Illinois.
Let me amend that, Chicago needs its own state.
Even if it did, the fed would threaten to cut off all federal funds to states not in compliance. Just like they did with the national 55mph speed limit years ago.
This kind of action by the States hasn’t happened in how long? The Ohio Senate just passed a resolution opposing Cap’n Tax. 19 or 20 States have passed 10th Amendment resolutions. What will the States do, when The One’s policies really start biting?
This measure, and the gun measure in Montana, are the types of state actions that will save our country from the 536+ pigs in DC.
I don’t know. I do hope they fight back though. They have a constitutional right and mandate to do so.
