Arizona Moves To Protect Residents From ObamaCare
Right Wing News ^ | 6/30/09 | Bill Teach

It appears as if the spirit of the 9th and 10th Amendments are alive and kicking in Arizona:

Voters in Arizona will decide next year whether residents will be subject to mandates in the pending health care reform that President Barack Obama and congressional Democrats are promoting.

At least five other states - Indiana, Minnesota, New Mexico, North Dakota and Wyoming - have considered proposals to take pre-emptive action against the pending federal mandates, but those proposals have either not made it out of committee, failed to get enough votes from one side of the legislature, or are still being crafted.

Only the Arizona Legislature introduced an initiative (HCR2014), which if passed, would amend the state constitution to codify that no resident would be required to participate in any public health care option. Arizonans will vote on the initiative in November 2010.

Good for them, but, I suspect it could end up in a Supreme Court showdown with any federal legislation, which is certain to include language similar to what ended up in the House cap and tax bill, which, in Section 189(a)(2) made it clear that any State law could be ignored.

It would have passed this year, except for heavy handed propaganda put forth by Janet Napolitano and the MSM. It came within something like a few hundred votes of passing. You could not turn on the radio without hearing Janet on an ad pronouncing doom if it passed.

It’s going to be interesting to see Obama enforce federal laws on the states. He does not has a civilian force (yet) strong enough to go into multiple states and enforce his unconstitutional “programs” (read: plan for the destruction of the US).

I can’t remember the President, but I remember the saying after a supreme court ruling (Jackson?) said “Let them enforce it”.

Just like local bar owners around me have allowed people to smoke in their bars in the face of a ban. Not a single ticker or summons has been written. The power of the people is still with the people. The police are people. The state police are people. The military are people (usually very conservative people). As these fights come to a head, it will be interesting to see Obama try to enforce the laws.

Just like the City of San Francisco can tell Illegals not to worry, we’re not enforcing immigration laws, conservative cities can tell their citizens not to worry, we’re not enforcing the unconstitutional federal laws - unless they deal with war, the navy, or an argument with another state. Other than that they need to mind their business. Kiss my arse.

Moving to Texas sounding better and better!

I think this will be accomplished by a payroll tax like Medicare. If so, even though a state might elect to not participate, the taxes will be taken out of individuals paychecks. That would be the heavy-handed, Chicago gangster thug politician way to do it.

Arizona has apparently decided to be one of the leaders in the charge against Potomac Fever!(No healthcare pun intended)

Another article(Thanks SunkenCiv and Army Air Corps) where Arizona displays their Constitutional muscle:

Arizona Looks to Outlaw Global Warming Legislation. I REALLY like this one!

>>the House cap and tax bill, which, in Section 189(a)(2) made it clear that any State law could be ignored.<<

If this is allowed to stand, then state legislatures and Governors might as well step down as they would be obsolete. Not to mention that this tramples all over what’s left of our Constitution.

Where are the lawyers? Oops, forgot that it is more important to overturn the results of an election that did not give you the results you wanted!

How much more will it take before we say ENOUGH!

Thanks For God's Sake for the ping!

I think the states also need to move fast to protect businesses, since according to the Obamacare draft they will now be on the hook for almost 75% of employee healthcare costs, or face being heavily taxed.
