Fed up with Washington's involvement in everything from land use to gun control to education spending, states across the country are fighting back against what they say is the federal government's growing intrusion on their rights.
At least 35 states have introduced legislation this year asserting their power under the Tenth Amendment to regulate all matters not specifically delegated to the federal government by the Constitution.
"This has been boiling for years, and it's finally come to a head," said Utah State Rep. Carl Wimmer. "With TARP and No Child Left Behind, these things that continue to give the federal government more authority, our rights as states and individuals are being turned on their head."
The power struggle between the states and Washington has cropped up periodically ever since the country was founded. But now some states are sending a simple, forceful message:
The government has gone too far. Enough is enough.

Paper tigers. Let’s see what happens when the FedGov tries to assert it’s unConstitutional authority in the face of these “resolutions”.

Sadly, the South was correct on State’s rights and wrong on slavery. They picked the wrong battle with the wrong opponent. 150 years later, we are pretty much stuck with the state’s rights result of the Civil War. A noble doctrine, the right of a state to secede, is forever tainted with the stench of slavery.
And, much of the same geopolitics exists today as in the Civil War. Washington will never allow the mouth of the Mississippi to be controlled by another nation. Plus, there are new factors. Now that taxes are direct, Washington will never let go it’s hold on tax revenues from Texas without a war.

The “interstate commerce clause” was NEVER meant to give the federal government the practically unlimited power it has grabbed. Just as the “general welfare clause” was never meant to allow the government the power to take money from one individual and give it to another.
I also think most of them are full of sh*t and will toe the line if the FedGov sneezes at them the wrong way.

I am questioning the resolve of theses states, too. The resolutions have no authority or legal weight. Are they going to ignore the next law that Congress passes that infringe on states’ rights or just roll over?
There should be a parallel movement to hold the line on the regulatory appetites of legislators and restore individual freedom. The States have encroached on retained rights of the individual just as much as the feds. have.
I hope we never have to find out...

The best --& really only -- answer to that question would be given by Jefferson Davis and/or the thousands of people slaughtered by Lincoln.
They're all dead now, and that leaves the Republic with a revised historical record, a revised historical record we'll all being seeing a lot more of in our near future.
