Unfriendly Fire; let’s end America’s lawfare against our troops

Last night on Freedom Radio, retired Marine Lieutenant Colonel Robert Weimann talked about his open letter to Secretary of the Army Pete Geren. Within it, 'Capt Roger Hill Case: Mister Secretary, it's time to end the double standard,' LTC Weimann demonstrates that political considerations have endangered the missions in Iraq and Afghanistan and resulted in more than a few unjust prosecutions of our troops.

Battlefield evidentiary requirements will be addressed within a revamp of the Military Commission Act (that was nearly hidden within Friday's White House announcement). With due respect to President Obama, those few select Members of Congress with whom he is negotiating, and the lawyers involved, if the Rule of Law overrides the Laws of War, that revamp will be reckless legislation.

This is America's war and America's sons and daughters are the ones fighting it. If the vast experience of front line troops is not sought and considered -- especially from those who have fought this war at the company level -- during the revamp of the MCA, a countless number of our troops will die and their missions will fail as a result.

So if you gave almost any U.S. soldier a gun with two bullets in it, and he found himself in an elevator with Nancy Pelosi, Harry Reid and a bunch of New York/Washington reporters and lawyers, there’s still a good chance that Nancy Pelosi would get shot twice, and Harry Reid and the rest would be strangled to death?

A Hellfire from a Prowler killing a house of civilians because the “target” has left, and the response is “oops....missed.”

An infantry squad against that same house and the squad members get prosecuted when the “target” departs.

That is a double standard.

This is not to argue that the Prowler controllers be prosecuted. It is an argument that war isn’t neat and tidy. Neither should be prosecuted.

On the battlefield any “murder” charges must be clear, convincing, with irrefutable multiple sources of evidence. Additionally, law must protect the criminalize any accusations against any accused by any elected or appointed officials. Violations of same to be considered tampering with justice.

Obama doesn't deserve much respect since he puts the importance of the soldier and the lawyer on equal footing in a time of war. From his Notre Dame speech yesterday:

........."The soldier and the lawyer may both love this country with equal passion, and yet reach very different conclusions on the specific steps needed to protect us from harm. "...............

In a time of war, I'll take the soldier over the lawyer any day to protect me and this country from harm.

Good article indeed. Will our military brass take heart to the problem and side with those that must bust down doors and open fire in hostile environments. Guess we pretty know where that has lead so much over the past six years or so.
