Sixteen-year-old Ashton Lundeby's bedroom in his mother's Granville County home is nothing,if not patriotic. Images of American flags are everywhereon the bed, on the floor,on the wall.
But according to the United States government, the tenth-grade home-schooler is being held on a criminal complaint that he made a bomb threat from his home on the night of Feb. 15.
The family was at a church function that night, his mother, Annette Lundeby, said.
"Undoubtedly, they were given false information, or they would not have had 12 agents in my house with a widow and two children and three cats," Lundeby said.
Around 10 p.m. on March 5, Lundeby said, armed FBI agents along with three local law enforcement officers stormed her home looking for her son. They handcuffed him and presented her with a search warrant.
"I was terrified," Lundeby's mother said. "There were guns, and I don't allow guns around my children. I don't believe in guns."
Lundeby told the officers that someone had hacked into her son's IP address and was using it to make crank calls connected through the Internet, making it look like the calls had originated from her home when they did not.
Her argument was ignored, she said. Agents seized a computer, a cell phone, gaming console, routers, bank statements and school records, according to federal search warrants.
"There were no bomb-making materials, not even a blasting cap, not even a wire," Lundeby said.
Ashton now sits in a juvenile facility in South Bend, Ind. His mother has had little access to him since his arrest. She has gone to her state representatives as well as attorneys, seeking assistance, but, she said, there is nothing she can do.
Lundeby said the USA Patriot Act stripped her son of his due process rights.

Sounds like the basis of a constitutional challenge to me.
Something doesn’t smell right with this story.
Ping!
This is only the beginning.
It just tickles me when people say this!
Really? Hmmmmmm.
Perhaps she should reconsider the significance of those Second Amendment rights that she has so casually dismissed. This woman may be ready to appreciate why partiotic Americans value the 2nd Amendment (and it's not for hunting).
Just a matter of time before they're knocking on all of our doors....
No it would not haven taken the FBI long to determine if her story was true. This may be one of those my son's an angle stories.
I am unclear on how the Patriot Act his stripped this 16 year old of his due process rights. The feds got a search warrant and they filed a criminal complaint against him. Sounds like normal process if being followed here.
Sure. She could[probably]be a liar.
However, I always side with people over Gov’t.
I agree. Its the moms story which may be correct. Kids can be stupid at this age and he may (or may not) have thought he was being funny.
Or it could be a white kid who loves this country and King Barry thinks that is a threat.
Obtuse or acute?
“Lundeby said the USA Patriot Act stripped her son of his due process rights.”
She believes that, specifically - “the USA Patriot act”, because what:
the FBI broke in claiming that that was their authority?
someone told her that?
what?
I am not sure how it is that she, or we KNOW the specific connection between the events at her house and “the USA Patriot Act”.
She may, in the end be right. Call me suspicious at this point.
Beyond the mother of the 16 year old invoking the scare words “Patriot Act”, the story isn’t even clear on whether the Patriot Act is involved in this case.
You forgot about the third player in this, the media. They may be selectively reporting what happened to make the story appear bigger than it is.
That's hugh... and series!
