A grand jury indictment is expected to be unsealed Tuesday in the case of a New York City police officer shown in video footage knocking a bicyclist to the ground in Times Square.
Officer Patrick Pogan has been told to appear for arraignment on charges in the indictment in state Supreme Court in Manhattan, said his attorney Stu London.
Sources familiar with the investigation said the charges against Pogan are expected to be misdemeanor assault and felony filing of a false instrument.
"He denies any wrongdoing in this matter," London said. "The video in question doesn't show the reckless behavior of the bicyclist prior to Officer Pogan taking police action. He was clearly disruptive and in accordance with the type of behavior the office was trained to prevent or stop."
Pogan was stripped of his badge and gun and assigned to desk duty after video emerged from the July 25 Critical Mass bicycle ride. The footage, shown widely on YouTube, showed Pogan shoving Christopher Long off his bike.
After the event, a monthly bike ride held around the world to draw attention to alternatives to motor vehicles, police said Long was arrested because he was obstructing traffic and had deliberately steered his bicycle into an officer.
In September, charges against Long were dismissed. Long's attorney, who had said his client is considering suing the city, could not be reached Monday.

Funny - my employer can and will fire an employee who has been charged with a crime.
You have no “right” to keep your job.
Cop went out of his way to nail the biker who was clearly trying to avoid.
Good bye badge and job. Cop should probably do a week in jail with his kind.
Correct. Long was not steering his bike towards officer Pogan. Pogan said he had steered his bike into another officer...previous to Pogan's action...which cannot be seen on the video.
The definition of “professional” means that a group/association has a standardized set of codes/rules that are enforced.
Doctors.
Lawyers.
and cops.
The NYPD has routinely SUSPENDED officers suspected of criminal offenses, even without a tape. Why not here?
They’ve got the videotape.
They’ve got the falsified police reports signed (sworn) by the cop.
Drawing a paycheck, even entering the precinct, is clearly too good for this guy. The offenses are so aggregious that he shouldn’t be wearing the uniform or working at all.
The cop should have his trial, but he shouldn’t be a cop while waiting.
So now there’s another officer that the cyclist was trying to assault?
We just can’t see him on video.
Got it.
Maybe there’s a “secret” police video that will disprove the cyclist and make the cop’s fraudulant statements true?
It that supposed to be a funny picture and a threat to bikers?
So what exactly IS your definition of a “cycle nazi”. For MOST people I talk to, and whose opinions I read, it pretty much means:
“Anyone on a bicycle, scooter, small motorcycle or ANYTHING other than a car, in fact, who even REMOTELY inconveniences ME in ANY way as I drive along in my SUV texting, reading a book, talking on a cell-phone, shaving, doing my make-up and generally NOT paying ANY attention at ALL to what is going on outside my vehicle”.
Does that about cover it?
Are you protected by a union contract? Cops are.
It seems that your point is not relevant.

While you want to be judge, jury and executioner you come off just sounding like an idiot.
Ah, that must be Jack “Hit’n’run” Cafferty.
i remember in Melbourne/Australia, the media caught a couple of police standing above a barricade with battons swinging at anti-globalisation protestors.
They got alot of heat, but apparently, there were police getting trampled by the protestor below the barricade that the media didn’t show, that they were trying to protect
PS - I’m a pretty “lucky” person, so I STILL advise “watching out” before you decide to KILL someone for the heinous “crime” of inconveniencing you.
Unfortunately for Pogan, the only video available shows him striking out for what appears to be no reason.
Is it possible that the biker did this to another police officer before his video taped encounter? Police officers do have the ability to radio ahead, even if they are on foot.
OK but if a officer is going to arrest you does it give him the right to slam you to the ground unnecessarily without using his training in the academy.
In the first one, a police officer is stopping a bicyclist that has just run a red light, and was refusing to stop. If you run a red light and the cop tells you to stop, you gotta stop.
In the next one, a cyclist runs into an officer who is holding a cup of coffee and walking in a crosswalk. Immediately beyond the officer, where the bicyclist would have been if he had been lucky enough to run into the police officer, a 40 foot RV rumbles through the frame at about 30 mph. But for the officer standing in the way, it would have squashed the bicyclist like a pancake.
I pretty much stopped watching at that point....
Hey, I'm not volunteering to go out and tackle bicyclists myself... That's what I pay taxes for!
Nightstick to the spokes works and he could have shielded it from the camera a little easier, make it look like an accident.
what if u are fired for being charged with a crime but are later found not quilty or plea to a BS violation?
you'd be pretty peeved and might sue your former employer, huh?
