Just so everyone here knows, the American Independent Party is now nationally affiliated with America’s Independent Party, which we founded in June. I’m the national chairman. Again, it must be said, the issue is not over, no matter how many people choose or want to believe that.

There are other cases pending in the court system that have raised these or similar issues, and today’s denial of a stay in one case does not have an effect on the other cases.

The court’s order that was published today has no binding effect on cases that were not under its current juridiction. To suggest otherwise reveals a lack of understanding of our legal system.

In the minds of those doing the “hiring,” they ALREADY HIRED THE GUY. Now you are viewed as the ICE officials coming in saying, “He doesn’t have the papers!” This insults you, cause you just hired the guy, so now you are even more determined to protect him.

There is enough reasonable doubt that he is a natural born citizen and satisfies the reqirement for President--otherwise why has he refused to show the world his true birth cert? Why have all his records been hidden, sealed so that we know almost nothing about him? There is no access to records in Kenya as I understand that too is sealed off.

All this will dog him for the next 4 years. And if all cases going to the SCOTUS are denied, it sets a precedent and you will see CA Gov arnold S installed as POTUS in *12.

I dismissed this all as kook stuff myself, until I started trying to figure out why the paternal grandmother says she actually witnessed Barack Obama being born in Kenya. Then the Hawaii thing was shown to be easily falsified, because anyone could register for a birth certificate in Hawaii in 1961, regardless of where they were born. Only when Jerome Corsi was arrested and deported while in Kenya investigating did I really start suspecting something sinister.

Only if you do so after 1982. That law was not passed until 21 years after Obama’s birth.

It was not a repudiation of Republicans. The vote count for registered Republications was way down. In other words they stayed home.

Why? John McCain was a candidate you love for his service to the country but just can’t stand as a politician. It wasn’t so much that he voted with George Bush 90% of the time it was that on the very large issues we absolutely disagreed with him and were disgusted with his openly condescending and at times dismissive attitude.

On immigration he not only pushed for policies in direct opposition to the majority of Republican’s but he had the nerve to openly insult us. He told us that the workforce coming from of the border is absolutely essential as they are doing the work “Americans won’t do”. What John fails to see here is that we feel the issue is our soveriegnty and culture. Furthermore, he openly said that work could only be performed by Mexicans. Apparently, they are more qualified than Americans.

He said to everyone “My friends, you can’t do the work these fine people do. In fact, I challenge you to come and do the work they do. I will pay you $50 an hour and you will see, you can’t do it my friend”.

This retarded attitude had me thinking hmmm $50hr x 40hrs= $2,000 per week=$96,000 per year! Is he crazy? I would have took that offer but it would have meant a serious cut in pay.

McCain-Feingold? Well, what can I say except ain’t it a bitter irony to be undone largely by your own stupid law. This guy couldn’t come up enough money to compete with Obama because of it and alot of other politicians were hampered by it as well.

The best thing this guy ever did was bring someone like Sarah Palin to National prominence. She generated alot of excitement and motivated many of us engage in the electoral process when we had decided to sit this one out and let the chips fally where they fall.

Still McCain was such a disappointment that there just was not enough energy created and his potential voting base decided to go to the movies rather than watch his train wreck.

So Obama did not win decisevely so much as we had a dog with fleas for a candidate and no one wants to be near a dog with fleas.

I understand that, in a civil case, the burden of proof is on the plaintiff, just as in a criminal case the burden lays on the prosecution. In the case of an applicant for a position, isn’t the burden on the applicant, and not on the employer? I’m not a lawyer, nor well versed in legalese, so I ask out of simple ignorance.

Also, in a civil case, isn’t the burden the “preponderence of evidence”, as opposed to “beyond a reasonable doubt”? In this specific instance, there is no evidence presented in the affirmative for Obama (IMO), because he refuses to provide any.

In a civil case, as you note, the burden is on the plaintiff to prove his case by a preponderence of the evidence. But there has to be a civil trial where evidence is introduced, subjected to cross-examination and admitted to the court, assuming it qualifies as appropriate evidence. For instance, hearsay is not permitted and documents must be authenticated, etc. So far no one has presented any "evidence" in any of these cases because evidence is only evidence after it has been introduced in a courtroom, made subject to cross-examination or stipulation and then "admitted" as evidence by the judge. Obama has not been required by any court to present evidence and none of the plaintiffs in these many cases has presented any evidence either. Just saying something is so is not evidence.

John Adams was one of the most unpopular of the Founding Fathers because he was unbending about what “the American people” wanted. He even tried to silence his opposition through the Sedition Act, and ten opposition editors went to jail. He also procured the authority to deport aliens but personally deported none. He represented MA and USA in a far different epoch. Today, he would be tarred and feathered by the mobs.

I’m not sure why you insist you are right, when the REALITY is that there are pending cases.

Are you aware of the specifics of each case?

Do you think that the Donofrio case was the BEST case to hear, or was it just the first case to reach the SCOTUS.

I was on your ping list and appreciate all your contributions to this site, but you are just wrong on this.

It isnt about hope or false hope either. As an attorney, i am following these cases with an intellectual curiosity, and I will continue to correct people who post incorrect assumptions about the legal system, its principles (it was already demonstrated that you were wrong on the evidenciary standard that applies here) and the effect of rulings on each individual case.
