My fear.
The Supremes are going into closed conference this Friday to vote on whether or not to schedule oral presentation of the Obama eligibility suit.
At least 4 of the 9 justices have to vote yes for it to be scheduled. This is the protocol for all cases….very few ( far less than 10% from what I understand) ever get scheduled for oral hearings.
In this case, it seems there is always a technicality that shuts down the process.
And I have to wonder about the dilemma the justices must feel…if they were to vote to schedule hearings–it will be explosive.
And they know this.
On the other hand how does Chief Justice Roberts with his pledge to uphold the Constitution swear in a man as US President if he has doubts as to whether the man lied to the American people and is not a citizen?
Answer: He keeps himself remote from the most incriminating information so that he is not faced with this moral dilemma. He stays on the surface, drawing no conclusions, deductions, giving benefit of the doubt to Obama--as President Elect. He and all the justices go into hyper-automoton mode.
So I tend to think–unfortunately–that the justices DO NOT WANT TO KNOW because in "knowing" they will inevitably be forced to have doubts--–which will unequivocably force a hearing.
I think they will likely vote to keep the Pandora’s box closed on some “technicality”. Hear no evil, see no evil, speak no evil.
Sad but true.
I think the Supreme Court’s decision will dramatically effect the future course of this nation. If they don’t consider the question in a substantive manner, Obama will not be considered as a legitimate President with some potential horrible results for the nation.IMHO

It will be a closed, secret meeting. I believe that they will punt - decide to do nothing.
The SCOTUS will look at the briefs on Dec 5th, decide there is no way they will jump into the middle of the political fray when the people of the USA have voted and decided Barack Obama is their President.

Of course it will. My point is that the founders, in laying out the checks and balances of the federal government, obviously never intended the Supreme Court to have the power that it does. Yet here we are.

Well, his Democratic opponent in the Primaries did not bring it up as an issue.
John McCain and Sarah Palin did not bring it up as an issue during the General Election.
Conservatives in the House and Senate have not brought up this issue.
Conservatives in Talk Radio have not brought up this issue.
You are correct, the Obama BC issue will not go away.
It will not go away because it has never been an issue and will not be an issue after January 20th when John Roberts delivers the oath of office to Barack Obama.
It hasn't been "sealed." Rather, he refuses to produce it.
Birth certificates are not public records in Hawaii.
The BC is the original, Doctor signed, official document with the state seal and so on, with all the pertinent information. The COLB is the "short form", if you will, with much less information. The COLB is the document that was posted and discredited. Sort of like the difference between the diploma you get when graduating and the little plastic card replica they give you for your wallet.
Here’s the non-lawyer answer.
A birth certificate (BC) is a legal document that proves citizenship and documents a live birth. It contains factual information about the child, his parentage, his race, the attending doctor, APGAR scores, weight/height, etc. It has signatures from the attending doctor and one/both parents. It has a seal.
A certificate of live birth (COLB), at least for Hawaii, is a document that the state issues to Hawaii residents that certifies a child’s birth to a resident. The birth did not have to take place in Hawaii. I would expect that Americans getting COLBs back in 1961 were those whose child was born overseas (e.g., Dad was a diplomat or an international sales rep). Basically, it means that a Hawaiian resident had a baby, somewhere else, and that we are documenting that fact.
You can imagine that in older days COLBs were also needed for children born on farms or on Indian reservations. My grandfather was born in 1905 in Arizona yet he did not get any proof of his birth until he had to register for WWII, in 1940. It was a COLB issued by the state of California.
The controversy here is that Obama’s mother, being a 1960s hippie, did NOT get her son a COLB. Because she cavorted with Africans, especially married Africans, she probably couldn’t have cared less what documents her son had. That also means that when she married the Indonesian fellow, it didn’t matter to her that her son’s citizenship changed. Also that he son might have claimed foreign citizenship while at Occidental college, and even continued carrying an Indonesian passport while a young adult.
Obama’s COLB was issued in 2007. Only when he was itching to be a Presidential candidate. Our Manchurian candidate was making a very last-minute attempt to cover his tracks.
