Controversy continues to surround President-elect Barack Obama's eligibility to serve as president, and a case involving his birth certificate waits for its day before the U.S. Supreme Court. A constitutional lawyer said were it to be discovered that Mr. Obama is not a natural-born U.S. citizen, it would have grave consequences for the nation.
According to the Constitution, a president must be a natural born citizen of the U.S. Mr. Obama's critics have failed to force him legally to produce his original birth certificate, and Mr. Obama has resisted any attempt to make him do so. Currently, only Hawaii Department of Health officials have access to Mr. Obama's original records.
Some of Mr. Obama's critics have said he was born in Kenya and have claimed he is a citizen of Kenya, Indonesia, or even a British subject.
Edwin Vieira, a constitutional lawyer who has practiced for 30 years and holds four degrees from Harvard, said if it were to be discovered Mr. Obama were not eligible for the presidency, it would cause many problems. They would be compounded if his ineligibility were discovered after he had been in office for a period of time.
"Let's assume he wasn't born in the U.S.," Mr. Vieira told The Bulletin. "What's the consequence? He will not be eligible. That means he cannot be elected validly. The people and the Electoral College cannot overcome this and the House of Representatives can't make him president. So what's the next step? He takes the oath of office, and assuming he's aware he's not a citizen, then it's a perjured oath."
Any appointments made by an ineligible president would have to be recalled, and their decisions would be invalidated.

Biden wasn't appointed by Obama, he was selected by the convention. There is nothing illegal about his candidacy, regardless of what Obama may have done.

Though I believe Keyes and he asserts this was said at the debate, there has got to exist a soundbite for this to be fully accepted.
The whole issue is black and white people and Yes or No. Obama’s Presidency let’s hope would be greatly emasculated if he stays.
The fine article by the Bulletin is one of the best I’ve read, the lawyer-author said he would resign being the attorney for someone that did not give up vital documentation like a BC.

How many times can Obama respond with a “motion to dismiss?” Hasn’t his legal team used this tactic before?

Here, let me fix that for me...

Won’t ever happen. If the Supreme Court rules obama ineligible [which I doubt] it will go to the House.
You need to read the article. This will NEVER go away unless it is resolved. In any criminal case resulting from a law signed by Barry; the defense will say that the law is invalid because Barry isn't President. They will force the subpoena of his birth certificate, because a criminal defendant ALWAYS has standing!
Until such time as a new president is qualified, and the vice president elect acts as president in the interim. That will be Biden since there is nothing that disqualifies him. And there is nothing that requires a new election.
You may very well be right; however, I think a well-qualified constitutional lawyer could put forward a very compelling argument along these lines. We are in very deep and never tested waters with this mess.

Thank you for posting this article. I sent the following email to the author. I hope we see a 1000 more articles like this to bust the truth out.

Thank you for your article. There is a great deal of anxiety out here because no one in the media seems to be reporting this critical information.
I believe Mr. Obama needs to prove to the American voter that he is a natural born citizen. He needs to show us respect and he needs to show the constitution proper respect. Our country and our principles are more important than an individuals’ wants or ambitions. Our liberty that the constitution provides hangs on a razor’s edge.
I am angry that our Legislative branch with the blessings of our Executive branch could go along and not lift one hand to verify qualifications of a Presidential nominee and perhaps soon to be President-Elect. I pray the Judicial branch of government has the wisdom to be the final interpreter and arbiter of our Constitution independent of political pressure and public opinion.
Please extend my thanks to your expert in the article, Edwin Vieira. I wish Edwin’s insight and your article could be viewed in every newspaper in America. The American voter needs to understand all the facts and hear the truth.

This is how it is going to go down: Alito, Scalia, Thomas and Roberts will likely seek to correctly interpret the “natural born” clause. The four die hard libs will seek to ensure that BHO is found eligible without regards to the facts. That leaves the entire decision in Kennedy’s hands. He will do what he always does and look to International Law. Not all IL, just the ones that favor whatever decision he wants to make. Kennedy will then decide that BHO is not actually a natural born citizen but that the constitutional clause is no longer useful as it was originally included to restrict someone with British loyalty from becoming POTUS. Therefore “it’s all good.”
True. And should be obvious to all by now.

They are going to have to find some way around this if they don’t want riots and don’t want to ignore the Constitution. They’ll probably have to loosely define the term Natural Born Citizen, or some other end-around.
